HERKIMER —.A Utica teen struck and killed a 47-year-old man walking Saturday night near the village-town border, authorities say.

Preston Scott of Herkimer was killed at about 6:50 p.m., state police said this morning.

The driver of the vehicle was identified by troopers as Jessica Zulla, 19, of Utica.

An autopsy is scheduled for later today date and no further information is available at this time. The state police in Herkimer are continuing the investigation.

The crash investigation closed West German Street to traffic as state police investigators probed the crash.

The victim, who investigators said was walking west, was struck by a vehicle traveling west on the street, Investigator Frank Spatto said.

He was trick or treating with his ( 7 yr old i believe poss 8 )son . Sad part is his child had to witness this happen. He was a good father to his son and prob had him bec his mom pawned him off so she could go out and about. Hope she smart enough to get him some therapy bec if the child didn't need it before he sure does now.

Why hasn't that girl been charged with anything yet? Everyone knows on halloween night you drive slower and keep your eyes out for kids and people walking around. She should've been charged with vehicular manslaughter by now? Or is it just because she is a 19 year old girl she gets off with no charges???

go back to the paper and news articles ..state police think NO charges,,lets see dark night ..in roadway..walking maybe with back to traffic. WHICH IS THE STUPIDEST LAW EVER TO HAVE. that way you see nothing.(or DO YOU HAVE EYES IN THE BACK OF YOUR HEAD?) accident happened on the curve or on the downgrade ???.(and the cops were told it was by the school first.)

There is no law that says you walk with traffic. Actually, walkers are told it is best to walk facing on-coming traffic.

Until you know the entire story, you should not be so quick to judge.
Accidents happen, tragic accidents happen, and this may be one of them.
Stop judging that which you know nothing about!

Don't you think this "girl" will be haunted for the rest of her life, knowing that this occurred?

What is your problem?

Ok I actually saw the road it was already dark, next to a cemetery. The roads were also WET? Does anyone see the connection.....most people call these accidents. And as for you twisted fucks making jokes or taking this with light humor perhaps you might think about go fucking yourselves. The man was a preston scott, 47 years of age I believe. As far as I know there weren't any reports of a child with him but unfortuately it is a possibility. I truly hope no child would ever have to witness such a tragedy. I actually know the driver personally and she is a sweet girl, would never try to kill anyone especially a man with a child. If she is charged that will mean 2-3 lives ruined. The man who is now unfortunatly deceased, the "possible" child on the scene. But what you people seem to forget sometimes is the life of the person who made a mistake now has to live with this for the rest of her life, putting her in jail/prison for something I'm sure was in no way intended would be ruining another persons life. If the kid was there, he could get therapy go on and have a great life. People learn from their mistakes, and it takes an even bigger person to admit their wrong doings. I'm sure if the police feel any kind of law action should be taken it will. It's truly a tragedy tho that this girl will forever know the true meaning of a haunted halloween. For the people who are actually sympathedic on here i commend you.

HERKIMER — A Herkimer man was trick-or-treating with his 8-year-old son Saturday evening when he was struck and killed by a vehicle, family members said Sunday.

Preston Scott of Herkimer, who is the brother of Oneida County Legislator Shannon Scott, was struck by a westbound vehicle driven by 19-year-old Jessica Zulla of Utica at about 6:50 p.m. as he walked west on West German Street, according to state police.

Shannon Scott said his 47-year-old brother, who grew up in Utica and moved to Herkimer a few months ago, considered his young son, Austin, a priority and wanted to take him trick-or-treating after a recent breakup with the boy’s mother.

Austin Scott, who lives with his mother, witnessed the accident, but was not injured, Shannon Scott said. Preston Scott, who attended Utica Free Academy, also had another son, Patrick Scott, 24.

“With his first son, the oldest, he didn’t have too much of a relationship, but with Austin he fixed that mistake,” Shannon Scott said.

State police investigators released few details about the accident Sunday.

"At this point we're not expecting any charges to be filed," state police Investigator Reece Treen said of the accident that occurred near the village-town border.

Treen declined to comment on the circumstances of the accident and why charges were not expected.

Shannon Scott said he would remember his brother, who worked at Richards Tire & Auto Service in Herkimer, as a man who had a passion for mechanics.

“If he wasn’t doing that, he was fishing,” Shannon Scott said.“He was just one of those happy-go-lucky guys.”

Arrangements are being handled by Dimbleby, Friedel Williams and Edmunds Funeral Home in Utica. They were incomplete Sunday.
