The Constitution enshrines the notion that we are all created equal in the Equal Protection Clause, in the voting rights amendments, chiefly the 15th Amendment and the 19th Amendment, and in large measure in the 13th Amendment,which abolished slavery.--Eugene Volokh, professor of law,UCLA. So this could have been much in the way it was voiced and not a matter of which document it appeared in.

So you are using these three amendments to uphold Obama referring to the Constitution while referencing the declaration of independence? The passage about all men being created equal was in reference to Americas servitude to a king! Nothing more, nothing less!
