A federal judge in California has knocked down the state's voter-approved ban on same-sex marriage, ruling Wednesday that the state's controversial Proposition 8 violates the U.S. Constitution.

The equal rights case was made, in both the appellate and supreme courts about equal rights with those same sex couples who are legally married, and those that are denied the right to marry.

i tried to address him, acknowledge what he'd said, in the hopes he'd move on...but he's stuck on this one note like a broken record.

The embarrassment should be born by the City manager (Chris Jeffers), Police Chief (Robert castro), City attorney (D. wayne leech) and his boss, with out forgetting the Glendora, California city council member's Joseph Santoro, Judy Nelson, Gene Murabito, Karen Davis and Douglas Tessitor.

4 Uphold Prop 8, not likely, however it will be quickly resolved in the next election cycle with another ballot measure that will easily pass.
1, 2 and 3 are equally likely in my opinion, I doubt we will see 4
But unless they overturn all of DOMA, and go for a broad ruling on Prop 8 I seriously doubt it will affect other states much in the short term.
In the long term.. oh yeah.. it is pushing the door that is already open wider and wider and either way it is only a matter of time before all states will recognize same sex marriage.

i'm just thinking of all those state laws & how they compare to Prop 8.....maybe i'm being a bit hopeful, and feeling a bit energized by the past couple of years of change, but that one by one, the state's laws will be declared unconstitutional by a federal judge on some level.

if part 3 is struck down, then that would mean federal recognition insofar as taxation, etc. which would be a giant step forward for same sex marriage. the case that was heard - that of the widow who's sueing for the tax money she'd paid on the inheretance of property both she and her partner paid for (some are calling her the rosa parks of this movement) despite being legally married in NY.

my question then is this....and i hope i can state it clearly. why wouldn't sect 3 falling and fed recognition of same sex marriages (as in for IRS purposes) affect all 50 states? i would think that it would - if the fed recognizes those contracts then the fed would expect all states to honor all marriage contracts from other states, just like any other contract. i suppose the work around would be for someone in texas (like me) go to one of the states that do offer same sex marriage & get married there in order to get fed recognition of the marriage for tax purposes. i suppose i'll have to wait and watch - and perhaps consult our attorney again (and make him richer, again) & see what he advises us to do to save on taxes in the long run in this regards.

First off.. yeah, how fast this has happened in this amount of time is an astounding success. And you should feel energized, the majority of voting Americans are now behind you, and the young as they come of voting age are already with you.

I donít think section 3 of DOMA can survive what we saw in the supreme court, even some of your opponents here have agree that section 3 is unconstitutional... that part is toast. And tht does indeed mean federal recognition, that is a huge step, sit back and take it in, you are already recognized in a growing number of states ( Delaware next I believe ) and after this judgment, federally..

That is huge, donít take any other minor skirmishes as big as that one. California will recognize them one way or the other in the next couple of years regardless of the supreme courts ruling on Prop 8, the DOMA win is HUGE.

And to answer your last question, because of section 2 of DOMA which I expect to stand.... for now.

"No State, territory, or possession of the United States, or Indian tribe, shall be required to give effect to any public act, record, or judicial proceeding of any other State, territory, possession, or tribe respecting a relationship between persons of the same sex that is treated as a marriage under the laws of such other State, territory, possession, or tribe, or a right or claim arising from such relationship."

But I am no lawyer, and I donít know all the circumstances, I am nothing but an interested bystander
