FBI taps cell phone mic as eavesdropping tool

The FBI appears to have begun using a novel form of electronic surveillance in criminal investigations: remotely activating a mobile phone's microphone and using it to eavesdrop on nearby conversations.
The technique is called a "roving bug," and was approved by top U.S. Department of Justice officials for use against members of a New York organized crime family who were wary of conventional surveillance techniques such as tailing a suspect or wiretapping him.

Nextel cell phones owned by two alleged mobsters, John Ardito and his attorney Peter Peluso, were used by the FBI to listen in on nearby conversations. The FBI views Ardito as one of the most powerful men in the Genovese family, a major part of the national Mafia.

The surveillance technique came to light in an opinion published this week by U.S. District Judge Lewis Kaplan. He ruled that the "roving bug" was legal because federal wiretapping law is broad enough to permit eavesdropping even of conversations that take place near a suspect's cell phone.

Kaplan's opinion said that the eavesdropping technique "functioned whether the phone was powered on or off." Some handsets can't be fully powered down without removing the battery; for instance, some Nokia models will wake up when turned off if an alarm is set.

While the Genovese crime family prosecution appears to be the first time a remote-eavesdropping mechanism has been used in a criminal case, the technique has been discussed in security circles for years.

The U.S. Commerce Department's security office warns that "a cellular telephone can be turned into a microphone and transmitter for the purpose of listening to conversations in the vicinity of the phone." An article in the Financial Times last year said mobile providers can "remotely install a piece of software on to any handset, without the owner's knowledge, which will activate the microphone even when its owner is not making a call."

Taking the battery out of your phone is the only way to keep the Sheriff's Department and Police Department from listening to your private conversations in your home or vehicle.

If yer worried about being spied on through yer cell phone all you have to do is implement the tried and true Melnor protection technique. Buy a large roll of heavy duty aluminum foil. Make a hat out of several layers of it Cover your cell phone in several layers of foil also. Wear the hat everywhere you go. This will defeat all but the dreaded black death rays. However, I would avoid wearing the hat outdoors during thunderstorms.

Local Law Enforcement committing crimes against it's citizens isn't a laughing matter.

Only a fool would throw their right to privacy away. By your writings, I imagine you'll attack me when I complain that the Police came to search my home without a warrant.

They don't need a warrant to come there or to ask your permission to search. If you gave your permission it's on you. If you didn't they likely DID NOT search. If they searched without your permission or a warrant and it was not incident to your arrest and/or there were no exigent circumstances you need a lawyer not an endless bitch session on here where you freely distort the facts and circumstances of virtually everything you say.

Sadly, there isn't an FBI agent within miles of here and local law enforcement likely has no idea how to go about figuring out what provider you use or what your phone number is. Take a break from your overwhelming paranoia.

There is an FBI agent living in Cleburne County. He lives in Greers Ferry. There is a chain of command that you need to follow, in order to be taken seriously! The place to start is the Arkansas State Police, file your grievance there first, and make sure you have a paper trail. Document everyone you speak too, makes copies of everything you file, and receive. The amount of abuse by this counties deputies, and local police is just out of control. There are some who BOLD FACE LIE, use and abuse their title, badge, and mislead people. There are some that without a doubt have broken the law, and no one seems to really care, or at least care enough to do something about it. Citizens are afraid of them, because they have done what ever they wanted to do for long, there is no longer that TRUST between the public and the law officials here. There just does not seem to be anyone around with the WANT TO....to clean house, and do the right thing.

People should really do more research when it comes to their rights, privacy, and bills that have been and are being passed on congress.
