"The core argument is over whether the deeds to the several churches property set up trusts for the Diocese rather than for the congregations of the several churches ...

"The CANA brief asserts, however, that the deeds don't create a trust for the Diocese and that various strong arguments favor the CANA congregations, not the least of which is that the Diocese would be unjustly enriched by the approximately $65 million that the congregations have poured into the acquisition, management and maintenance of the churches with no financial assistance from the Diocese."
