A federal judge ruled Friday that the morning-after pill, known by its brand name of Plan B, should be available without a prescription or any age or point-of-sale restrictions within 30 days. The ruling is in opposition to a previous decision by the Obama administration.

Judge Edward R. Korman of the U.S. District Court for the Eastern District of New York ruled in Tummino v. Hamburg, reversing a prior decision by the Food and Drug Administration (FDA) and Health and Human Services (HHS).

Plan B (Levonorgestrel) is an emergency contraception to be taken within 72 hours after unprotected intercourse to prevent pregnancy. In 1999, it became the first emergency contraceptive approved for use by prescription. In 2006, the FDA approved it as an over-the-counter drug for women over the age of 18, while requiring a prescription for minors. The FDA subsequently allowed 17-year-olds to obtain the drug without a prescription.

In 2011, the administration backed an HHS decision, overruling the FDA, to not allow women under the age of 17 to obtain emergency contraceptives without a prescription.

Korman's decision demands that the FDA make the drug available with no restrictions within 30 days. The judge specifically ruled out the agency using the rulemaking process to slow the ruling, saying that it had already engaged in "intolerable delays" in responding to the Citizen Petition asking for the drug to be made available over the counter.

The Center for Reproductive Rights, which filed the lawsuit against the FDA and HHS Secretary Kathleen Sebelius, celebrated the judge's decision in a statement on Friday.

“Today science has finally prevailed over politics,” said Nancy Northup, president and CEO for the Center.“This landmark court decision has struck a huge blow to the deep-seated discrimination that has for too long denied women access to a full range of safe and effective birth control methods. Women all over the country will no longer face arbitrary delays and barriers just to get emergency contraception."

Drugs, even prescription drugs are dangerous and have dangerous side effects. The idea of saying an eight year old child can be given this drug and have it given on demand, the idea of a 10 year old, etc, getting this drug or any drug is questionable. Heavens any child trying to buy an over the counter drug should be and think would be questionable about such a purchase by any responsible adult working at the point of sale.

What is it with you and incest. I'll won't deny it happens and that those who engage in it should hung up on a meat hook by their genitalia but the way your right it is happening in every other family on they block. Yes here, no not there, yes here, no not there, yes here, no not there, so and so and so on. Could it be that you were a victim of incest and now you see it everywhere?

I find it hysterically funny that you could correct spell perspicuous but you can't spell Why, Are, you, For and other such simple words. Oh and by the way, to my perspective, this drug is not birth control but a form of abortion in its own right. Hey that doesn't matter to you does it? It doesn't that perhaps another baby is being killed. It's just a mass of cells or as you said once, it's only a fetus. It doesn't matter that scientists have a distinctive DNA stream of a human being, different from all others in that abortive tissue does it?

I wish it were good news. The girls around here are too stupid for plan b. Wrap it up fellas, a condom feels better than a baby. Then you don't have to worry about her.

Silly people. You can conceive on birth control but the baby doesn't implant right. It is killing a conception if you believe lofe begins then.

First, you are right. I know nothing about your education but I do know it is lacking if you can't spell YOU and have to use U instead.

Have I left SEMO? Hell yes. When I was in the military my duties quite literally took me around the world and I have been able to see and enjoy the cultures of several places that most people only dream of.

Concerning your little pill. I am sorry to tell you this but your reaction is in direction opposition to Obama and what he wants for Plan B.

Please note his reference to the fact that this stuff does not belong on the shelf for open purchase by anyone. He talked about how it didn't belong next to "Bubble gum and batteries". Here comes the shocker for you. He and I totally agree on this.

Well, Hello.

Jd is just stuck in the 80's or just stuck. He sounds like my old buddies of mine that fuss about the younger generation.

I have heard older people fuss about the younger generation since I have been "knee high to a grasshopper." Some things never change.

Go make your mark on the world. jd will still be here fussing about the younger people and how they talk and walk and everything else he can find to fuss about them. Some things never change.

I don't recall ever being stodgy enough to talk about the old generation and compare it to the new generation. But you comments did make me smile, thank you.

I think if we could really go back in time and factually learn conversations of the past, the older generation has fussed about the younger generation forever. I can almost hear some cavemen sitting around watching the young hunters go off on the hunt.

"What do they know? They got them fancy spears and then rocks they made into knives. We did it right in our day. We got out there with rocks and sticks, we surrounded that mammoth and beat it done like it supposed to be done. Sure made the meat a lot more tender and tastier than it is now when they stick it with them spears."
