Im not saying the original driver who made a mistake was faultless. The point here is that after you cross lee highway to the railroads you become trapped -- based on the lack of a regress route. Additionally, the whole set-up provides narrow confines that become a liability in case of a power outage.

The quantity of accidents proves -- that with human error there were severe architectural deficiencies with the train crossing at lee highway. Dont let your anger draw you into imbecile like insults. The driver was wrong, but the construction is poor.

The construction is good enough for thousands of drivers every day.

You may be missing the point. Yes this driver was stupid and wrong. Maybe the construction is poor, but this person made a serious mistake that could have cost lives, including hers, and then she claimed she did NOT stop on the tracks. Since the train hit the SUV she was driving, it is clear she must have stopped on the tracks but she refuses to accept the blame for her own mistake. She blames everything else.

Stupid people can learn but people who refuse to accept their mistakes do not learn. In this case, this driver is likely putting people at great risk every day.

I was NOT on the tracks. If I had been on the tracks, my car would have been destroyed and I would be dead. There were also two cars behind me, so I could not back up. There have been at least three accidents here in the last year. Others mentioned the gate did not come down. Maybe you should contact the other drivers and witnesses and ask.
The judge dismissed the charges against the driver stating no laws had been broken.

The judges DISMISSED the charges against the driver. No laws were broken.

The judge was personally familiar with the area and traffic issues and dismissed the charges against the driver.

One of the drivers charged with stopping in the box had their charges dismissed as well, but had to pay court costs.
