Key Cases Loom in Pennsylvania Gay Marriage Fight

When U.S. District Judge Mary McLaughlin decides this year whether Pennsylvania must recognize same-sex marriages from other states, she'll do so from her perch above Independence Mall, where about 40 people staged an early gay rights protest in 1965.

AND, without the Federal DOMA to overturn in the courts, it would have been FAR more difficult, from a legal point-of-view, to get our cases before the SCOTUS. We'd be stuck with a state-by-state process pretty much forever.

So, once again, the bigots ended up shooting themselves in the foot with their bigotry.

It's no coincidence that we were completely unsuccessful before federal courts challenging state bans prior to DOMA being overturned.

It's often said that things happen for a reason...

Without DOMA, Baker might still be valid precedent. The law inserting the federal government into marriage mooted that case.

Without Prop 8, there would have been no trial showing the bankruptcy of the proponents' claims.

Without BLAG, we'd have had no nationwide recognition of same-sex marriages.

And without the visibility of the trip to SCOTUS, Judge Walker's ruling would have been just another circuit court decision. It is now part of the legal lexicon, and has been cited by justices in different circuits.

I think it's clear that Clinton was a mixed bag on lgbt rights (and lots of other things like trade and public assistance,) in a very homophobic environment.

Too bad he so naively promised he would repeal DADT with no apparent understanding of exactly how hated lgbt people were than and how much pushback there would be. Even from such hilariously "respected" people as Sam Nunn, the cretin.

I believe even Sam Nunn lived to regret his role. Certainly, other participants in the DADT debacle realized their folly. But I agree with everything you said.
