Gary came to the Hauula Community Association mtg last night, talked for a long time explaining his dreams of keeping his 4.2 acres of property in his family...the trials and mistakes he's made trying to make it happen, how with these trying times he has a $26,000 montly morgage payment that's killing him...how his son's found $ to start to build the 2nd beach house very soon...the law says 40 foot setback from shoreline...the new place will be 45 feet...he will install a 48" pipe along the south side of his property wall (which are 5 feet in from his propery line to give his neighbors more space to direct the mountain runoffs to the ocean and not into his neighbors backyards/homes. He took off from his website that he has 400 feet of private beach. He no longer seeks wedding receptions (only 3 more to go, then pau, music curfew at 9pm) He again showed his dream plans for 12 more single family dwellings and 3 duplexes on his property.

One community member stood up called him a liar to his face

Again he claims he just wants to be a good neighbor and one day move from the Bay Area and live happly ever after in his dream house surrounded by his son's n' daughter's and family....he has a website and e-mail and he's willing to talk story....anyone else have a take on this meeting?...speak up/out

You need to contact (KHON Action line Hawaii). They will help you get your money back. I was in the same situation you were, don't worry you'll get it back, but it might take a while.

As long as there is a green spot on Oahu, there will be an outsider with a cement mixer wanting to cover it up for cash. Sorry Hawaiians, you sold all your land to go to vegas.

According to BYUH's Student Newspaper there are 700 New Transfer Students this Semester! who needed off-campus housing in the area!
http://kealakai.byuh.edu/index.php ...
Wheelwright & BYU are worsening our AFFORDABLE HOUSING Crisis!
Funny, BYU officials said that there would be no increase in new students until more student housing was built....BYU spent $$$ on the new show, but no $$ on building new dorms on campus!
What ugly politics ! Wheelwright is using students to push out locals from lowcost housing!
Such a strain on so many local people who need Affordable Housing!

Its called the freemarket system. Its what happens. How many people in the states have been pushed out of their homes to build wal marts and the like? you just have to move, thats all. I have been to Hawaii, I have been to that property and i know that there are a lot of people there who, by choice, dont really have regular jobs, and just live off of the increase in their home values. If you got a job maybe you would be able to afford to pay more than the college students and you wouldnt get pushed out. They are college students for crying out loud they have less financial means than ANY fulltime worker working ANY job. Get off your lazy bum and get a job and youll keep your house no problem. OR write to your congressman about how its illegal for Mr fanger to rent more than once a month. If he could rent regularly he would probably open his property up to locals for a low price (that was originally his plan actually, i know him and saw the designs of this house before it was ever built. But YOUR GOVERNMENT stopped him and hes having trouble getting his return on investment because of it. That property cost MILLIONS of dollars. Thats why people are getting screwed (which i think is very wrong and now how i would run his business, but thats his problem. though i will say that not refunding money is a very common (though unethical) business practice practiced even by the big hotels and travel agencies in Hawaii) they are getting screwed because hes terrified that since he cant rent his property as he likes, if he does comply with every refund ASAP he will lose his property. which isnt even bringing him a profit anyways.) Plus, BYUH is the best thing to happen to the north shore of Hawaii since surfing became big. Look at how it is helping LOCALS to have the opportunity to better their own community. Its by far the most diverse college in america, with more polynesians per capita than any other college. It is the best rated college in ALL OF HAWAII and its also the cheapest university in america. Not to mention that beyond it being cheap, if you are a polynesian you get a sweet job at the cultural center, which, by the way, brings all of the tourists that shop and eat at YOUR BUSINESSES. without the college you would all be living in a poor hopelessly rural community and people like Mr. Fanger would be able to exploit you even MORE. If i were you i would rather have BYUH students pushing you out, who are honest and hard working, and actually give back to the community than people like mr. fanger who are only there for the money. So chill out and move. and stop whining. You live in america its your fault that you even need low income housing, get a job, go to colege, start your own business. FYI Mr. Fanger comes from a very poor background and has been completely destitute more than once in his life, but because hes a hard worker, he now owns that property and others. You could too, just stop whining about change, because it always happens and it always will. and look for the opportunity in life and then go take advantage of it.

Legislation should be made to require all vacation rentals to obtain the proper license and permits (a high fee to generate income for the State) on an annual basis. When ads are placed they must have their licensed printed and revealed it or they pay a hefty fine. If illegal rentals are discovered, then they must pay a substantial penalty for every day it is operating (maybe a $1000 per day fine), to deter such practices.
Further, before any vacation rental is made available. The adjoining property owners within a mile radius must agree to it. Aside of the land use commission.
Further, inspectors generally don't do their jobs until complaints are made. Inspectors need to get aggressive and hunt the illegal operators out or the City should "terminate" the "do nothing inspector".
Good thing you arent a politician. Being an entrepenuer I can assure you that were such laws passed, i would summarily cease doing business in Hawaii. In truth, they should put less regulations on business and people like Mr. Fanger would have no reason to not refund peoples money. Whats so wrong about tourists anyways? in my experience, having lived in San Francisco. Tourists are generally very respectful and make the locals a whole bunch of money.

Im Mr. Fangers son. He may be rich, but he wasnt always that way. Hes a completely self made man. And anyone else could do what he did if they would think outside the box a little and start their own business. Thats why I love america. Anyways, Everything he said at that meeting is true. Hes building 12 homes because he has 12 children. He never would have even rented the property if it werent for the recession, which put him in a position where if he didnt rent it out he may have lost it.

As normal, the media got their story wrong. If a residentially zoned property does not have a Non-conforming Use Certificate (NUC) to operate as either a transient vacation rental (TVU) or bed and breakfast lodge (B&B), they CANNOT provide visitor accommodations that are intently occupied for less than 30 days.
According the City and County of Honolulu Department of Planning and PermittingÂ’s Mike Friedel (Code Enforcement Officer) and Art Challacombe (CSO Manager), properties without a NUC that demonstrate a trend of providing transient accommodations occupied for less than 30 days are in violation of ordinances No. 86-96 or No. 89-154.
The regulatory intent of ordinances No. 86-96 or No. 89-154 is very clear. Transient rental activities are prohibited in residential zoning unless a property has a NUC. Courts will always consider the intent of the law in interpreting the application of the regulations.
Illegal TVU and B&B operators who create fraudulent 30-day contracts and provide accommodations occupied for less than 30 days are violating the law, even if no other visitors occupy the rental during the same 30-day period.
<quoted text>
Where can you report illegal B&B? Or at least have someone look into it. I have one across the street. Because the residents and tourist all stay on property, their over flow parking is now in front of my house. Yes it's not illegal to park there but now I have no space for my guest. They have nine cars and I have two. It's just very irritating.

The city has an on-line complaint form where you can report all sorts of things. I've used it for potholes, graffiti, abandoned cars, missing road signs, etc. The nice thing about it is there will be a good, permanent record of your complaint from start time to finish. They will not ignore you and will keep you informed of their progress a long the way. I usually see results in a couple of days.

Just checked their site as it's been a long time since I've used it. It's still up. Just google Honolulu complaint form and check the box marked "other". Type in your complaint and send'er in. It will be forwarded to the right place, and it WON'T simply disappear. Let me know how it works out for you.

God forbid he might be taking much better care of his property than some of the slums all over Oahu with multi-generational families who dump their crap all over their yards, public streets, highways, and parking lots. There's ALOT more people who live here in Hawaii full time who run illegal rentals; GO AFTER THEM TOO! But you'll never see that b/c they're all local, not haole's.
In response to "Waikiki local", your "bubba's" statement is very condescending and as an indigenous Hawaiian I am offended by your display of ignorance. For those who wonder why many Hawaiians are passionately angry, it's because of people like you who acquire the land for a home, where our children have none. People like you who segregated the schools where our kupuna were forced to learn servicing skills, not academic skills. People like you who, to this day, help to hide the truth in order to preserve your selfish ways. May you be blessed, and may you receive all you deserve.
