If a worker wants to speak to his coworkers in spanish and there is no rule at teh work place against it i see no reason why they cant speak amongst themselves. If they happen to offend a customer then the employer should make it right. It speaks volumes that the woman who was bilingual didnt put a stop to it and was planning on trying to milk this for all its worth, obviously wasnt very offended if she didnt cut them off earlier.
The employer did make it right. They fired him.

So you are basically saying that its OK to speak Spanish in front of customers even if it gets you fired? You are making no sense whatsoever. All your crowing about "freedom of speech" means absolutely nothing in the workplace. Go use your free speech and insult your boss and see where it gets you. Or insult customers like this guy did. There is no free speech in the workplace.

And you need a lesson in manners. regardless of workplace rules, its rude to speak in another language in front of others. Especially customers.

So the next time I see a couple of "Spanish" women or men at Walmart while we are all standing in line I guess it's ok to talk to my friend about them and call them filthy dirty and ask her why do they always smell like greasy food and I'm talking to my friend in ENGLISH!!!

Hey if they want to speak spanish in front of a customer and its against company rules and they get fired let them, i dont see where you get off saying i need lessons in manners, im not the on speaking different languages in front of people. Like i said, if the company has no issue with it and the workers want to talk amongst themselves it is their right to do so, and if it offends someone and they get fired for it so be it!

If I were these ladies, I'd go to Tribal Court. With casino revenue way down, I bet they'd give them $500k each just to end the suit and the bad publicity. Good luck ladies...

Who cares...if you are offended by an employee at a place you are spending money at then make a stink to the mangers/owners and dont go back if it bothers you that much...you have a choice not to shop/spend money at the place. Im sure you have talked badly or even whispered to a coworker about a person of the oposite sex in terms of their apperance
No where in my comments did I say I agreed with this lawsuit. It's out of control and there are plenty of other ways to get this issue resolved without resorting to demanding money. The VIP room and comping was perfectly adequate for what happened, but the employees should at the least have been reprimanded (for all we know that has happened).

Marigliano should have confronted them right then and there. The humiliation of being "busted" would make them think twice before speaking Spanish in front of people they assume don't understand the language.

I do not believe that anyone here is condoning the actions of the casino employees. Termination would be the appropriate action in this case.
What the folks here are condemning is the legal action taken by these so-called victims.
Freedom of speech is not an absolute right, especially in the workplace. The employer can set the tone and conduct required by employees within the scope of their employment.
Furthermore, your FOS rights are not absolute in Walmart either. If one utters something management considers offensive, they can be removed from the property by force if required.

first of all, if the woman understood what these idiots were saying why didn't she stop it immediately. It sounds like she let them go on for a while.

Second, What the article doesn't mention is that the workers have been fired. At least that's what the news report I heard this morning said. Also the women accepted the offer of the VIP treatment.

Now they want to sue. I wonder if they would sue if the "pockets weren't so deep"

Get over it ladies. So they called you names. Big deal. Have you yourselves never called anyone names? Free speech is what makes our country great. Take your business elsewhere and do not try to win your losses by suing the casino! Try playing at Mohegan Sun and if they call you dumb broads then try another casino. Get real ladies.

Half a million per charge? So that's 1.5 million to the both of them together or individually? I agree that they should have said something to the casino managers after this. The funny thing is though, that they would have no idea what was said if the bi-lingual lady didn't speak up first. It's too late and to sue for 500k for a couple remarks? That sounds more like they're trying to compensate their losses over the extravagant weekend.

I don't know what pi$$es me off more... that this lowlife roulette worker thought he could get away with insulting paying customers in Spanish or the fact that the greedy customers now think they deserve $500,000 each in "damages."
This is all the fault of the liberal mindset. People should not be allowed to speak Spanish in the workplace and people should not think they are entitled to a half million dollars for being verbally insulted.
This country is screwed in so many ways.
I agree with ya. I would have just complained to a manager, maybe caused a minor scene and cussed out the dealers in spanish, and taken my business elsewhere. Not sued for half a mil...

Slightly off topic, I don't go to Foxwoods any more. I tried it a few times, and they just really need to learn how to treat their customers. Mohegan does it so much better it's not even a contest.

Like many others on here, I think the law suit of $500K per woman is ridiculous. It's excessive and wrong for several reasons: 1. only one woman understood the comments, 2. said woman apparently made no attempt to inform the rude casino employees that she could understand them, which raises the question of how injured was she not to protest immediately, and 3.$500k is far too much for bruised feelings.

The casino employees were rude and disrespectful to these customers. If they have not already been fired, they should be. Apologies should be made, and a rule enforced by the casino manager that foreign languages will not be tolerated around customers unless said customer requires speaks a foreign language and requires a translator.

Freedom of speech has nothing to do with this case, as it involves a workplace indiscretion. Employers do have the right to limit free speech to ensure good customer service and return business. If an employee decides they would prefer to exercise their constitutional right to free speech; then, they need to be ready for the potential consequence of losing their job.

When you visit a foreign country, do you expect people to speak English? The Spanish speaking population is expected to comprise the majority in this country by the year 2050. So, let's see. We can bone up on the language, especially the slang, or we can shrug it off. Frankly, those workers could have said I was a spotted lizard with a forked tongue, and even if I understood, I would not have cared, let alone filed a lawsuit. Sticks and stones, no matter what language spoken, is what will break my bones. Name calling is juvenile and I always consider the source.

This incident disgusts me. I have always contended that individuals who speak a foreign language have the right to speak it amongst themselves, even when in public, but the workplace is a different matter. If a Spanish-speaking work crew wants to communicate in Spanish outside of the presence of English-speaking co-workers, fine, but no employer should allow their employees to chat between themselves in a foreign language in front of customers. It leads to situations like this, especially with service workers (which these casino workers essentially are) who may be resentful of their jobs in the first place. They plaintiffs should call for the workers' firing as well.
Brilliant! I work in retail, and if I have a group of customers come in, wether they're spanish, indian, whatever....if they start to speak their language amongst themselves in front of me, I walk away. It's insulting. There's no way to know what is being said, for all I know they could be directly insulting me basically to my face.

I was at McDonald's a few weeks ago and a spanish speaking women who was working, was asking me something about my order in spanish!! I do not speak spanish, so after giving her the "What" look 2 or 3 times, she got all pi$$y at ME for not knowing what she was trying to say!!

English should be the official language of the United States. People that emigrate here should be required to know the language!

I was at Foxwoods about a month ago and an employee looked at me in a lustful manner. Iím definitely going to sue them now. Iím thinking $2 million should cover it! But seriously, this is America and anybody can sue anybody else, for any reason, at any time. Oh, how I love this country! However, it does not mean they will win. Most people are just hoping for some quick hush money.

I donít believe this is anything other than an attempt to hustle money from the casino. People and companies with deep pockets are always being sued over trivial things. I bet $100 (but not at the casino) that if, these guys were penniless patrons there would not be a lawsuit.

I donít condone this type of behavior by anybody. However, I feel compelled to mention the following and I mention this because a few young ladies posting here have taken this incident and tried to turn it into a crime against women.

I have been to the casinos many times and some of the most vulgar language and inappropriate behavior, I have every experienced has come from female patrons in the 30 Ė 50 year old range.
