Oh good grief. Let's blame everyone else except this woman's bad choice to get pickled and walk across a major highway. I hope they throw this frivolous lawsuit out of court.

67 years old and a 0.30 BAC at 7 PM?

Kids, be lucky your Mom lived this long. She sounds like a complete alcoholic to me.

I can't beleive they are blaming the bar!! I wouldn't try to cross 309 when I'm sober in broad daylight. I can see getting mad at the woman who hot her and kept going, but blame the bar? That's just being unreasonable.

This is sad and unfortunate but I agree. To blame the bar for this is not fair. What happened to being responsible for yourself... about the person who hit her and torched the car, they'll probably try and sue the car manufacturer for not stopping the car for her...

"The suit also says Montana West should not have allowed Gibbons to try to cross Route 309 and did not provide a safe ''transit path'' for patrons who are leaving the establishment.

Maybe Montana West should spend two million dollars and build a pedestrian foot bridge over 309 leading to the trailer park? Or maybe the taxpayers should have sprung for a traffic light with a crosswalk in front of Montana West so the drunken scumbags can safely cross the street and return to their trailers.

you know there are way too many sue happy people in this world and it is a shame. why on earth would you put the blame on an establishment for your mothers actions, sure she was drinking and clearly drunk. if the children were so concerned about their mother than why didn't they go and pick her up? and better yet why didn't mom call and say she needed a ride. anyone in their right mind, sloshed or not, knowing that 309 there is dangerous (BASED ON THE FACT THAT YOU LIVE THERE!) would walk across that highway sober let alone drunk. I agree with my predecessors' comment that this case is certainly not worth taxpayers money! Let's sue someone because someone has poor judgement and unfortunatley lost their life..........

Sorry your mom was killed, but I concur with the previous entries which state her decision to drink is the reason she's dead. No law suit, no money.

They know they cannot get $$$ from the driver(in prison, liability only), so they are going for the establishment. New law, who ever has the most $$$ pays. Just ask the guy that owns strawberry acres.
Steve you are SOOO right, w/BAC at that level in early evening, she was drinking all day, no doubt most of it in her MOBIL HOME.

I agree with most of you on this one. There are a lot of sue happy people out there. However, the woman that hit her should have stopped! What a stupid move on her part! DUH! Bartenders should know when to "cut" people off. Crossing a major highway was also a dumb move, but when you are that do dumb things. What a shame!

I've been a regular on and off for a long time at Montana West, and I've seen times where it was so packed that their parking lot has been completely full, and people end up parking up the entire melody lakes and a couple business' next to them... So all those people leaving the club need to cross 309 to get to their cars. I've done this numerous times personally, but you should know that you *ALWAYS* take a risk upon yourself when crossing a 4 lane highway where people do between 60 and 80 mph on average at that time right in front of the club. I see full sized rigs doing these speeds right in front of the club all the time. Imagine getting hit by one of them.

But sue Montana West for this? That's absurd, even if they have too many people there and use their 'overflow' parking areas... Your off their property once you step on to Rt. 309.

I'm sorry that this lady passed away so tragically, but once again, the blame gets pushed off somewhere else. And while a pedestrian bridge was the first thing I thought of, do that many residents of the trailer park go to Montana West to warrant one being built?

people drink more when they can "walk" to a bar from home. also, if you are walking to a bar (and that drunk) you are definitley a frequent customer. i wouldnt appreciate being cut off from the bar i walk to. but at the same time i hope people wouldnt blame somebody else for my drunk decision making.

Puleeze! When are people going to take responsibility for their own actions???? Another case of "lets get rich" from the results of a tragic accident.

You know maybe people who drink should take the responsiblity as well not just the providers- Have you ever been at a bar like montana west- its huge with a lot of people in it- the bartenders can't keep track of every single person in the bar and some people don't appear to be intoxicated until its too late... The lady did this to herself not the bar! Just another money hungry person seing dollar signs.

Thats what you get when you put a bar across the street from a trailer park!

this is yet another moronic lawsuit. at 67 years old you should be capable of making grown up descisions. This woman lives across the street so she knows how busy 309 is yet she still decides to get hammered and try to cross it. As far as I'm concerned this is not the clubs fault. the only truth to the accusations is that the woman that hit her should have stopped.

hmmmmmm, that gives me an idea... instead of saving up money to leave for my kids ..... I will just get drunk at an establishment and then get killed walking acoss the road so my offspring can sue.

What BS, Montana should not be held liable for ANY stupid behavior that happens once people leave this establishment. That would be like saying all these DUI accidents can be blamed on the bars the people got drunk at.

Courts shouldn't even acknowledge this lawsuit. What a waste of taxpayers money.

People should have to pay a fine for ridiculous law suits.
