Fischbach is definitly not the victim in this horrible situation. Nick Smith is the only person to have wrongfully and unhumanly been shot and murdered. There was nothing random about this incident, did you ever hear of coworkers??? The main difference now is that Nick can not share his side of the story and only the lies of Fischbach are being heard.

Nick had been struggling and obviously he wasnt in his right mind. I feel horrible for him and for his family but there needs to be some sympathy for the victim that was beaten as well. You are right the evidence will come out. You all saw the picture of Fischbach on the stretcher with a neck brase being loaded onto a Life FLight. They dont do that for just any minor injury. I am also sure that nmany pictures have been taken of Fischbach's injuries hopefully they will come out as well. But with privacy act info and crappy journalism who knows when we will get all of the evidence. Yes Nick can't speak for himself but that is what investigators will work to find...evidence not just hearsay. Also I am not the only person that has stated that there was a third party involved. Don't forget the person that dropped Nick off in Littlestown instead of taking him home like he was suppose to why would he do that? That is the link that needs to be investigated. And by the way the cops know all this I am not stupid and neither are they!

All these comments, but no one here knows the full story. All of you can argue back and forth with assumptions, what if's and maybe's. The full story is not told here, as it may never be.

Everyone and the paper keep saying there was no sign of a break in. Lets look at it from this point of view. This is not a big city it is a small town. It was the middle of the day. How many of us have our doors looked all day. In small town USA alot of people don't even lock there doors. If the door was not locked then there would not be signs of a break in.

Some people were saying that Mr. Fischbach wasn't hurt that bad. Then why was life line called. I was in Littlestown that day at the car dealership across the street from were they landed life line. In the amount of time it took them to get him to lifeline and load him up and take off. They could have gotten him to the Gettysburg hospital. You can drive to Getysburg or Hanover Hospital in about 20 minutes with lights and sirens going a lot less time.

My heart goes out to Mr Smith's family and friends- believe me - there are people out here that feel your pain.
Don't know where you heard it is prescribed for terminal patients.
I was given Oxycontin by an oral surgeon for pain I had in my jaw that was not easily diagnosed. It turned out to be a severe infection of the sinous area that extended into the jaw bone, and I was begging to have route-canal to remove what I thought was a problematic tooth.
Unfortunately, given the Oxycontin drug for the tooth pain didn't do anything good. In fact, I had a severe case of hives to the skin, and I had joint pains and swelling of the hands and feet as a reaction.
So, evidently there are times when Doctors prescribe Oxycontin for patients other than terminal ones.
When someone enters your home, uninvited and threatening like, there is little time to respond especially if it is a drugged person. So, there has to be the ability to protect ones self without having to run out the door of your home or to allow yourself to be physically beaten , before you can answer the urgent need to wound or kill that attacking and threatening person. That is my own thought, and hope it doesn't come my way or anyones way I know.
But one should be prepared for that event, as 911 calls aren't much help when a minute or two is all you have at best before you are attacked.

There has been a lot made of the fact that the burglar in this case, you know, the criminal, was unarmed when he was killed. So let me ask all of you this question: Could you shoot an unarmed man in the back? Is it ever justified?

Now, to those of you that have immediately said no, let me put it in context:

You are walking past two warehouses. Between them is a chain link fence, thirteen feet high, topped with razor wire. The fence is slightly buried in the concrete sidewalk. The warehouses go on for as long as the eye can see, and there is no way to see how wide they are. You have a legally carried, concealed firearm on you.

As you pass the fence, on the other side, you see a man, holding a five year old child. He is sexually assaulting the child. As he does so, he chokes the child with his hands. You hear him say to the child that the child is about to die. The child is begging, crying, screaming. The man is laughing.

You yell for the man to stop and get away from the child. He doesn't turn, and doesn't stop his attack. He says, "Don't worry, he'll be dead in a minute."

What do you do?

Again, I ask, could you shoot an unarmed man in the back?

still so many unanswerd questions, for all of us who love and know Nick, we know you were struggling with your demons but you still did not deserve to die, nobody does.. I've know you all your life and my feelings will never change I will love you until the day I die. The papers never reported any injury to you except a gun shot, they failed to mention, your bruised face, your stolen promise ring,that you had been to John's befor that you had money in your wallet,I stand behind you and will defend you forever,I Love You and Miss You. It is so unfortunate that Nick died in this situation. Nick did have friends, and you know who you are, that were aware of his addictions. It is so sad that not one of these "friends" would help Nick before this tragedy happened. All is fun until someone gets hurt or DIES. Rest in peace, Nick.

Iam sorry that you can still speak with your brother, as i can not. Sorry that your brother was selling drugs, that was well know in littlestown. When we find out that your brother is a MURDER than what will you say. You have know idea what me and my family deal with eveyday of our lifes. Yes my brother did have a problem but how did he know that your brother was selling, if he hasnt got them from him befor? Can you answer that question? Your brother can lie about everything but one day the truth will come out one. Thanks.

Are you on the life line crew? Fischback was not put into intesive care was he? If I recall he wasn't in the hospital for more than overnight, was he? They jumped the gun on taking him on life line. He wasn't hurt as bad as he wanted everyone to think. I do not pitty him. Others that know him has stated that he sells more than oxycontin. I wouldn't buy it, don't need to. I wouldn't buy it regardless from him. He is know for shoot ask later.

As for locking the doors, oh yeah I have my doors locked when my husband is not home. Ergo the "lock the door in the daylight as well as night". I know alot of folks that lock their doors day or night. If I am exspecting someone and I need to check the laundry and they are to be there then maybe I'll let the door unlocked.

I do not own a gun, but if someone forces their way into my house and does not leave when I ask, if He is armed or un-armed, He is getting a Loisville Slugger to the head non-stop till the police arrive. Lots of unknowns in this story, but apparently he was somewhere he was not wanted.

It is a Constitutional Right to protect family and property.

The truth is that your brother was an opiate addict. There are only three kinds of opiate addicts, ones who are using, and ones in treatment. Clearly he was one that was using. The long term prognosis for a person who is addicted to opiates is worse than most cancer patients, that is to say a person with advanced stages of cancer is more likely to survive. If he did not go in to an extensive in-patient treatment for several months of rehab he did not have much of a chance anyway. The DRUGS killed him, unfortunately it was sooner than later.

I was a friend of Nicks and was at the funeral. I think about him and his family everyday and miss him. Is there any update or any more information on the investigation?
