My heart goes out to Mr Smith's family and friends- believe me - there are people out here that feel your pain.
OxyContin is not just for terminal illness. I have been prescribed OxyContin for pain relief. That is what it is for...whether you are dying or not. Get your facts straight before shooting your mouth off. Let's not forget that this man was protecting himself, and who cares why he was prescribed Oxycontin. If the label has his name on it, then my dear, it is his. Mr. Smith's actions alone have caused his family grief. Mr. Fishbach did NOT harm Mr. Smith's family. Mr. Smith harmed his own. I feel for Mr. Smith's children as their father was nit thinking of them first. I feel for Mr. Fishbach as he will live with this horror for the rest of his life. Mr. Fishbach is the victim, so don't play the criminal to be the victim. Addiction is a self created illness, and you do not get help unless you want help. This man wanted drugs not rehab. You make me sick.

hey , someone walks into your home..no matter how they got in , walked in cause door wasn't locked or break it...your in my home..its called TRESPASSING . what happened is what happened..one dead man who can't speak , one man who shot and killed him...plus GOD knows. sorry that nick is dead ..maybe he was a good person, but good people do go bad. especially for OXYCONTIN.. search the word..and what people go thru or do. i know too well about this drug , 7 years and still legally taking it for extreme back pain. oh , and i did all the therapy and pain management etc. so i know what its about. palladone was better , except it killed people who thought it was okay to drink alcohol with it. they found out and its off the market. and having a gun in the couch or nite stand , if you can legally have it , you can have it anywhere. why , you have to post sign now ..saying gun in house. idiots...

I think there are alot of things missing from this story and everyone is excepting what they hear without thinking about the facts. How did Mr. Smith know that Mr. Fishback had the pills, most likely because he had gotten them from him before. Also for everyone judging Mr. Smith who are you to pass judgement and say it is ok to take anothers life. My prayers are with his family and I hope they get the justice they deserve.

to my opinion the story seems a bit weird the person who robed himdemands the drugs and the guy pulled a gun that was near his couch and shot him dont you think the robber would have enought to to take the gun away? i mean the story doesnt add up the think Fishback should do some time for even SELLING the oxycottin and nick is just as dumb as his Addiction risking his life over stupid pills and has 3 kids wut a idiot!

Mr. Fishbach was flown to a trauma center. There is a picture on the website of the fire/flight crew loading him in the Medavac.

Also, if there wasn't a struggle then why did Mr. Fishbach has injuries that Trained Medical Personnel thought he needed air lifted to a Trauma Center.

Get over this bickering about Poor Nick, Bad Mr. Fishbach. It's an unfortunate incident that happened for an undetermined reason. You all need to have respect for the family of Mr. Smith, this type of addiction can be hidden and maybe the family didn't realize this was going on. As for Mr. Fishbach, he will have to live with this for the rest of his life. Not something I would want to have to do, right or wrong.

I think you are the ones that need to do alittle research before you comment. As found on the Internet: The maker of the highly profitable narcotic painkiller OxyContin has been aggressively marketing the drug far beyond its original purpose to ease the suffering of cancer patients, according to company documents released . Purdue Pharma for several years has promoted the powerful drug to treat less-threatening ailments, such as arthritis and back pain, according to company. So Miss Tracey and Miss Christina, the physicians have taken it upon themselves to see what else it might work for- not as the intended purpose. Could it be for alittle kick back??? Someone I know was given because they hurt their toe. So, if Mr. Fishbach was allegedly/possibly selling it, then his pain wasn't awful enough if he could afford to do without some of it and therefore didn't need the prescription in the first place.

As someone who has known Nick for 15+ years, I cannot believe that he would ever intentionally hurt anyone. He was also a victim in this horrible situation. I have known several people who have been addicted to many types of drugs and they struggle daily and will for the rest of their lives. Having not spoken to Nick in several years, I do not know the severity of his addiction, but it had to have had a very strong hold on him to cause him to act in this manner. This man did not have to hold a gun to his chest and shoot him point blank. I'm sure he could have shot him somewhere else and the beating would have stopped. There are so many details of this story that we will never know and it is a shame that three beautiful little boys have lost thier father. Yes, Nick was wrong in what he did but so is Fishbach.

My sincere condolences go out to the Smith family. I will see you on Saturday.
