Can someone explain this to me? How can an alley be private property but alloy the public to use it?

If the township won't mark the alley as private and enforce it then I would expect them to maintain it.

The landowner has the right to put up a 'private drive' sign.

Do you really want the township to pay our tax dollars to put up gates and signs at the back of everyones property?

And do you expect the township to maintain every driveway that does not have a private drive sign? If they do it once they will be asked to do it again and again, and will not be able to legally refuse. Bye, Bye tax dollars.

If the alley is private but there is a public right of way, then aren't the landowners entitled to "Right of Way" fees from the township????

A sign and gate at the back of everyone's property is a bit extreme and unnecessary don't you think? A sign at each end of the alley and a little law enforcement (when they're in the area) may help the matter and go a long way with the residents. Not saying it's an end all be all, but at least there would be an effort, and most people appreciate that. The issue here is the township is not going to post the alley as private, they're going to still allow public use, and although not confirmed in the article, they may not maintain it. It's like Joe Schmo using your driveway (not alley) and expecting you to have it maintained and free of debris, snow, etc. for him. All I'm saying is, if the township isn't going to make an effort to post the alley as private then they should have to make the effort to maintain the publicly used alley. It seems quite simple really - either pay to post some signs or pay to maintain the alley. I wonder what they'll decided is better use of taxpayer money? I'd bet they choose neither and pick an even better way to spend tax payer money...litigation.

That sucks. Just put up a privite drive sign. I will try to respect it if I see it.

what martha should do is be creative and not sweep up the nails, tire spikes, and broken glass that are in the alleyway and not on her property

Does this really make sense to ANYONE???
If someone who has property connecting to that alley, can they be charged with trespassing by simply going down that alley to get to their property? Do I have this correct? After all, portions of that alley are broken down into individual sections of private property.

Here's a solution.....put speed bumps at each property line. That way no one will speed. The homeowners that have property bordering the alley are responsible for the upkeep. If the neighbors have the money, put up gates on each end and only the homeowners have keys to the gates.
It's really sad that the people driving down the alley have no concern for safety. REALLY SAD when the police won't even help out with traffic control. Whatever happened to helping your neighbor out?????

Ever homeowner has a 10 foot right away on the front of their property for utilities. If there is an alley there is a 10 foot right away check yor deeds. Midway has some of the best alleys in the township.
