This video was from 2009. Perhaps the problem, if any, has been addressed in the past 5 years?

I'm not saying what the officer did was right because it was not. But why is this video coming out now?

Oh yes lets all feel bad for Mike Bergeron. Him & 2 cars of people he associated came to my house because he commented on a pic & his physcotic girlfriend or now ex gf wanted to fight me. No one deserves to be assaulted/ or made to feel victimized. But I can tell you, he isn't innocent.

I have to say that the dousing with pepper spray was a nice touch just for good measure. I guess if you're going to brutalize someone, just like anything else, you may as well do it to the best of your ability. What they did was wrong but at least they were thorough! People go around breaking laws, committing crimes being habitual offenders forcing law enforcement to deal with them and then they complain about the hand they are dealt. The answer is simple, Stay away from trouble and don't put yourself in harms way.

Looking at the big picture, could this town possibly have a more well rounded variety of employee related issues? More paid leave, attorney bills, outside investigator expenses, big payouts over grievances,$100k + to fire a TM. LOL

Not to mention part-time employees (aka the guys who do most of the actual work) are now only permitted to work 28 hours/week. This is after they all work 40 hrs/week without any benefits for the town. The town is cutting from those who least deserve it and continue paying the ones who should be off the payroll.

Seabrook PD never released this voluntarily, and never releases any 91-A material, even when properly requested by an inhabitant of the town.

Bergeron's attorney obtained it through the discovery process (Rule 98) by court order. Bergeron allowed his attorney to hold on to the tape, but the latter disappeared, even changing his number. After tracking his attorney down, he was able to upload this.

Here's the problem: That police station is full of videos covering bookings where folks from the area alleged sexual harassment, threats, beatings, etc. Now that the FBI, U.S. Attorney, and AG's Office are looking into this, they will get access to those tapes. Plaintiff's attorneys from all over New Hampshire and Mass are going to be looking over some really terrible videos that will go public, generating shock and anger from jury after jury.

It's not the officers who will be paying out six and seven figure settlements and judgments. It will either come out of the general fund or result in sky high insurance premia that show up on your property tax bill for years to come.

This Town Management needs to get it's act together as a group effort and stop tolerating the various infractions of certain employees for all the wrong reasons. It seems Selectmen are more concerned about not offending their pool of voters than they are about preserving the Town's best interests. Poor decisions are made which end up costing the tax payers in the long run with law suit payouts. A little proactive thinking and action would go a long way and help things get back on track before we pass the point of no return. It seems like every week there is a new crisis to deal with which could have been prevented. This PD issue is going to cost big. The kids attorney is well known for his expertise in this area of law practice. He will make some big money in the end. The Town should do background checks on all other employees to cover its back and see what it turns up. If the Town Charter states no felons can work for the town then so be it. Never mind who the felon is, what's good for one is good for all. That's the way it has to be, period. As for part timers, I always thought that the definition of a part timer was "someone that works under 40 hrs a week"? Why are they doing most of the "actual work"? Because it is allowed? Have the full time permanent employees do it. If they are physically incapable then they aren't employable and need to go and replace them by hiring a part timer "full time" Is there some rule that says you are entitled to come to work for the town and become a lazy fat ass and not have to perform any physical tasks? I don't think so. It goes on because it is "ALLOWED" Elections coming up.. what a cluster f, Lets be careful about the next fools that get voted in for personal reasons!

The selectmen are only concerned with lawsuits and how they look on camera and nothing else. They absolutely do not care about the injuries sustained by people who have been hurt by police or criminals. Seabrook needs people who act in the best interests of the townsfolk, not just do what town council and the police chief tell them to do.
