At this point I really don't see us getting any money because the state is going to claim it is broke.This is an absolute shame,it has been 26 yrs.

There has to be some recourse for us. I asked John Schroder about it at a town meeting. He said that a state figure would have to propose the money be paid to us and no one wants to do that!(NOT A DIRECT QUOTE!) Also, the Katrina folks in New Orleans want to sue Corps of Engineers. How can they even consider this suit knowing that we were never paid on a suit that we have won?(circumstances being similar).

Like I've said before,I have talked to Peck,Pugh,and Layrisson and I get different answers from each.Like you said,there has to be some recourse.Maybe we should go to local papers and news stations with our story?

I would suggest putting it in writing! You have to leave a paper trail with CC at the bottom. We should send a letter to the new Governor and our newly elected reps. My mom recently sent a letter to Mr Jindal and did receive a call. She wasn't home when the call came in and they haven't called back yet. But if the claimants are to go to the media, you need to have something in writing, showing your requests and demands for answers. This way, we can show the response or lack of one, to make this 26 year old story new news. Cheryl is right... There is a new suit against the Corps. It's making the news now and if that is news, than why wouldn't their lack of payment ordered by a Supreme Court not be? Every single person needs to send a letter and Carbon copy the letter to each recipient. Just a suggestion and we need to find a really good spokesperson that possibly could represent the age and time of passing of the non-payment for interviews with media

Now is the essence of time. The legislature is in session. I am almost sure there are prob. around 1,000 people some way involved in this case. If nothing is done, than we need to make a pact to take our votes and move them. We have to do something different!!! If they can't represent us than we all need to agree on who to vote for next time and vote in that direction. Some of our reps only won by a very small margin!!!!!! We can vote until we find the reps. that represent the citizens devastated by the flood over 25 years ago in their state, in their district, in their region. And Oh... last time I checked, we didn't need the Federal stimulus dollars and LA, supposedly, was not affected by the current economic crisis. And... my state taxes surely aren't waiting to find the money in my BUDGET!!! Taxation with NO Representation... I just can't figure out the part about a Supreme Court ordered judgement not being paid!!!!! If that were one of us, they would garnish our wages and put a lien on property. I just don't get it!!!!

Well... I'm not sure. I wouldn't know where to begin to get a list of all of the claimants or to see who would be interested. I'm not sure if I can even remember most of the people in the claim anymore. We all look so different. I guess I just don't know where to start. But... a good start would be to get everyone to send a letter. I do think we need to find a spokesperson with good stature so we have a go-to person for consistent responses in our representation. Does anyone know the family that first filed the case? Wasn't it Boudreauxs? God it's been so long. Too long!!!

Louisiana Revised Statutes Annotated 13:5109 (B)(2) states:

"Any judgment rendered in any suit filed against the state, a state agency, or a political subdivision, or any compromise reached in favor of the plaintiff or plaintiffs in any such suit shall be exigible, payable, and paid only out of funds appropriated for that purpose by the legislature, if the suit was filed against the state or a state agency, or out of funds appropriated for that purpose by the named political subdivision, if the suit was filed against a political subdivision." (Emphasis added.)

The thing that I am afraid of is that these lawyers are willing to settle on any amount of money.If that happens,then most of the money goes to lawyer fees and they walk away millionaires and we may get a few peanuts.I know alot of people think Peck is crazy bastard,he may well be,but this lawsuit has been his baby since day one and I think he is more for the people than all of these other "Johnny Come Lateleys".Whoever is in charge,I hope we get a fare shake.I also know that HB865 is still in the House Appropriations Committee,but it is also up to Jindal to give the go ahead to pay the money.I would appreciate any new info. if you have it.

the latest on the case is that the house bill 865 will pass but it has to through the following house floor,sen.floor,gov's.desk i was told that this will be the last time they pass it because the state is getting tired of trying to pay their debt and the lawyers not take it if that happens then it is all over from there we start all over again (another 26 years) steve pugh is on our side he is trying to do everything in his power to help us i trust him i am praying this is the end i will not give up on us thank you god bless

Hey Wesley, thanks for the updates,I appreciate them.What lawyers are you talking to and what are there feelings on us finally making a deal.My personal feelings are that I do not trust Layrisson,but then again I do not trust any lawyers.They may represent us, but they are only out for themselves.Now that I've gotten that off my chest,keep the info coming.THANKS!

We need someone from our state, a representative perhaps to fill out the required, form discussed above. "The Claim for Indemnification and Contribution" on behalf of the victims for payment. Any Suggestions?
