It's said that there's plenty of debris in and around the building....... a perfect opportunity for some of these people in our local jails to be put to work in clearing fire hazards around here.

I believe this shows that the County Board should ban the sale and ownership of fireworks as a precaution in the county. I suggest the City of Deming also ban any and all sales and ownership of fireworks and if called both City Police and the County Sheriff need to confiscate the fireworks and fine the owner for even having them as the County Ordnance #72 has a total ban on Fireworks and open Fires. If there is a total ban and a resident has fireworks in their position this seems the owner should be sighted and the fireworks taken under the rule of suspicion of passable use of fireworks. This will eliminate the chance of the use not allowed under the Ordnance 72. Also under 4-37-4. NMSA 1978 Enforcement officers in counties; duties. stipulates
"A. It is the duty of every county sheriff, deputy sheriff, constable and other county law enforcement officer to:\) enforce the provisions
(2) diligently file a complaint or information alleging a violation if circumstances would indicate that action to a reasonably prudent person; and
(3) cooperate with the district attorney or other prosecutor in all reasonable ways.

B. Any county law enforcement officer that fails to perform his duty in any material respect is subject to removal from office and payment of all costs of prosecution.

So for me common sense says if a county resident has fireworks then the Sheriff or any appointed official should confiscate the illegal fireworks and issue a citation for having illegal fireworks in their position as a common person knowing they are illegal in the county there is a strong possibility of using the illegal fireworks so, just take them and remove the temptation of using the illegal fireworks.
