South Carolina Attorney General Henry McMaster is telling members of a task force that targets Internet sex predators to continue their work despite a judge's ruling that could put the cases in jeopardy.

Circuit Judge Mark Hayes ruled last month that investigators incorrectly used a federal law to get the identity of a suspect accused of trying to solicit sex from an undercover officer posing as a 13-year-old girl.

McMaster has appealed the ruling but acknowledged that most pending cases would be threatened if the decision stands.

"Frankly, it's a much worse scenario than we originally thought," said McMaster spokesman Mark Plowden. "The consequences of that order being upheld are dire."

The judge's ruling came in the case of 33-year-old former prosecutor Anthony Clark Odom, who was charged with criminal solicitation of a minor after authorities said he used the Internet to try to entice what he thought was a 13-year-old girl to have sex with him.

Hayes ruled the federal law authorities used to get subscriber information from Odom's phone company and Internet provider was not supported by South Carolina law, and he wouldn't allow the information to be used at Odom's trial. Prosecutors said they need the information to link Odom to the online chats.

The federal law only requires a judge to sign a document. Hayes ruled state law requires a higher standard, including probable cause and submitting a sworn oath, to obtain similar evidence.

The task force made its 85th arrest Thursday - 75-year-old Donald Joseph Murphy of North Charleston was charged with one count of criminal solicitation of a minor.

Of the previous arrests, 24 have resulted in guilty pleas and two defendants have been found guilty at trial, Plowden said.

In his letter to the task force, McMaster noted that the use of the federal "d-order" has been upheld by another South Carolina Circuit Court judge.

"No one can guarantee the outcome of an appeal, but I am confident that our d-order process is sound and will continue to utilize it vigorously to prosecute these sexual predators of children," McMaster wrote.

It doesn't seem right that someone's rights under the SC State Constitution can be ignored in order to invade their privacy. If this were the case, it seems we could just do away with our state constitution and only depend on the U.S. constitution to protect our civil liberties and individual rights.

The adult men and women who are posing as 13 year old minors have questionable honesty and integrity. This is nothing more than an illegal entrapment scheme. If an 18 year old man or woman in prison had access to the Internet and was communicating inappropriately with one of these liars, even though there is no possible way that they could actually meet nor assault a minor since they are confined, they would be guilty of a crime. Lord help us when the Republicans figure out a way to read people's minds.

We are disappointed that DSS wasn't responsible enough to take this little girl out of this abusive environment. Sometimes just turning custody over to the grandparents is just a front and the child remains in the same threatening environment.

This family has a history of child abuse, fraud, drug and alcohol abuse and stealing. At the time of this alleged incident with the Ex-Councilman both of her brothers and sister were in jail. Also, since the summer of 2005 her sister has been arrested multiple times for using crack cocaine while pregnant, auto theft, and credit card fraud. Her brother was arrested for having a concealed weapon in the SCDMV office. Yet this minor continues to stay in this home environment.

DSS doesn't protect the children. They are lazy, not trained, stupid, not child friendly. This is the Greenville, SC office I"m speaking about. The turn around is terrible. The caseworkers don't care if they protect the children or not.

It has been disclosed that the 13 year old alleged victim who accused Ex-Councilman Russ Ferrara of inappropriate touching was undergoing sexual abuse counseling at the time of the alleged incident and had previously accused at least two other men of sexual abuse: one being her father. Earlier the alleged victim claimed that her father would enter her bedroom each morning at dawn and sexually assault her. Authorities were aware of these allegations which were much more severe than the allegation lodged against the Ex-Councilman, but elected not to arrest the alleged victim's father. Authorities were also aware of the family's attempt to obtain money from the Ex-Councilman to assist in release of the alleged victim's sister from the Aiken County Detention Center.
The judge who placed the Ex-Councilman on house arrest was arrested for sexual misconduct and has recently resigned from office. Judge Jack Early ordered the councilman be taken off house arrest.

this reminds me of the time we labeled everyone with an opinion other than our own as a communist. I guess Judge Mark Hayes who determined that Anthony Odom's privacy rights were violated is a predator. Also, Jack Swerling, the attorney who's defending Anthony Odom is a predator too. However, the lying dog cop who posed as a 13 year old teenager on the Internet and who probably enjoyed sharing his/her childhood sexual fantasys during 4 months of chatting, is a Christian saint who should be given the medal of honor.
