37 indicted in Carter County

Feb. 10, 2010 On Friday, Feb. 5, indictments were handed down against 37 people by a Carter County Grand Jury for a total of 72 counts.
Indictments are as follows:
James C. Greenhill, 22, of Holcomb Street, Grayson, was indicted on one count of first-degree robbery by robbing A. L. using a pistol on Jan. 16, 2007, a Class B felony.
David Gilliam, 63, of Biggs Branch, Olive Hill, was indicted on 25 counts including rape in the first degree by engaging in sexual intercourse with a female minor under 12 years of age between July 16, 2003 and July 14, 2004, a Class A felony; 12 counts of rape in the second degree by having sexual intercourse with a female minor less than 14 years of age, during 2006, Class C felonies; and 12 counts of rape in the second degree by having sexual intercourse with a female minor less than 16 years of age, during 2007 and 2008, Class C felonies.
Stephanie B. Smith, 24, of Teague Drive, Greenup, was indicted on one count of criminal possession of a forged instrument, second degree, by possessing a forged check in the amount of $214 drawn on City National Bank on Feb. 24, 2009, a Class D felony.
April Dawn Sallie, 30, of Ocean Blvd., Ft. Lauderdale, Florida, was indicted on four counts including: 1) possession of a controlled substance, first degree, first offense, by unlawfully possessing Thebacon, a Scheduled I controlled substance, a Class D felony 2) possession of a controlled substance, third degree, first offense, by possessing Xanax, a Scheduled IV controlled substance, a Class A misd. 3) tampering with physical evidence by attempting to hide pills on her person and attempting to swallow pills knowing they would be used as evidence in court, a Class D felony, and 4) resisting arrest by Officer Cox and during the arrest attempting to bite Cox on the hand on Nov. 12, 2009, a Class D misd.
Matthew A. Kiger, 27, of West Main Street, Grayson, was indicted on one count of fraudulently use of a credit card by making unauthorized purchases on a credit card belonging to Ms. Kiger with such purchases being a total of $943.92 on May 28, 2009, a Class D felony.
David T. Hill, 25, of Highway 174, Soldier, was indicted on four counts including: 1) first-degree fleeing or evading police in the first degree by operating a motor vehicle while under the influence of drugs and alcohol in violation of KRS 189A.0105 and failing to obey a communicated command to stop the operation of the vehicle given by a KSP trooper while operating his siren and blue lights, a Class D felony 2) operating a motor vehicle while under the influence of alcohol and fleeing and evading from a KSP trooper, a Class B misd. 3) speeding by operating a vehicle 26 miles over speed limit, a violation, and 4) operating on suspended or revoked operator's license on Dec. 26, 2009, a Class B misd.
Jack D. Binion, 20, of Fox Hunter Road, Olive Hill, was indicted on one count of promoting contraband, first degree, by having controlled substances while being an inmate in the Carter County Detention Center on Nov. 7, 2009, a Class D felony.
Vanessa Kidd, 35, of Carter County Detention Center in Grayson, was indicted on one count of promoting contraband, first degree for possession of controlled substances while being an inmate in CCDC on Nov. 8, 2009, a Class D felony.
Angela Marie Evans, 32, of Halcomb Street, Grayson, was indicted on one count of promoting contraband, first degree, for possessing controlled substances while being an inmate in CCDC on Jan. 1, 2010, a Class D felony.

Rachel Griffith, 29, of 5th Street, Grayson, was indicted on one count of criminal possession of a forged instrument, second degree by having possession of a forged check in the amount of $50.01 drawn on First National Bank of Grayson on Nov. 14, 2009, a Class D felony.

Marshall w. Perry, 44, of Aden Road, Olive Hill, was indicted on three counts including, 1) first-degree stalking by intentionally stalking C.P. By traveling in a motor vehicle to her house and parking in the rear of her house after having made threats to kill her and being armed with a shotgun, a Class D felony, 2) criminal trespassing three degree by unlawfully going on the remaining upon the premises of C.P., a violation, and 3) operating a motor vehicle while under the influence of alcohol on Dec. 7, 2009, a Class B misd.

Justin Lezu, 21, of Luci Mae Drive, Flatwoods, was indicted on one count of second-degree burglary, when he burglarized the home of A.P. on Nov. 26, 2009, a Class C felony.

Burl E. Porter, 89, of Rt. 1, Grayson, was indicted on one count of capital murder by firing a single shot from a revolver and fatally wounding and killing C. Porter, a capital offense on May 27, 2009.

Cynthia Gray, 31, of Carter County, was indicted on one count of theft by failure to make required disposition of property by taking possession of $2,700 worth of Girl Scout cookies and failing to pay for them on March 30, 2009, a Class D felony.

Mary Kimmel, 41, of Hwy. 1, Grayson, was indicted on one count of theft by failure to make required disposition of property by possessing a Sony Laptop computer valued at $699. under a lease arrangement from Rent to Own and then selling it to a third party and keeping the cash proceeds on Nov. 30, 2009, a Class D felony.

Danielle N. Kouns, 30, of Old Townhouse Br., Grayson, was indicted on one count of theft by unlawful taking of a Ford automobile owned by Thomas Hall valued around $4,000 on Jan. 5, 2010, a Class D felony.

Kathy E. Jones, 58, of Little Sandy Lane, Grayson, was indicted on one count of first-degree trafficking, first offense, by trafficking in oxycodone, a Scheduled II controlled substance on Oct. 21, 2009, a Class C felony.

Jason E. Gilliam, 29, of Goodale Road, Hitchins, was indicted on one count of first-degree trafficking, second offense, by possessing for sale oxycodone, a Scheduled II narcotic controlled substance while having a prior conviction for first-degree trafficking on Dec. 11, 2009, a Class B felony.

Rebecca L. Gilliam, 22, of Goodale Road, Hitchins, was indicted on one count of first-degree trafficking, first offense, the Scheduled II narcotic oxycodone on Dec. 11, 2009, a Class C felony.

William Kilgore, 27, of Garris Road, Olive Hill, was indicted on three counts including, 1) first-degree robbery by threatening to use physical force while armed with a knife and in course of committing a theft at the Dollar Tree Store on Nov. 30, 2009, a Class B felony, 2) first-degree robbery by threatening to use physical force while armed with a knife and in the course of committing a theft at the Dollar Tree Store on Dec. 9, 2009, a Class B felony, and 3) first-degree robbery by threatening to use physical force while armed with a knife in the course of committing a theft at the Dollar General Store on Dec. 10, 2009, a Class B felony.

Jeffrey Plowman, 41, of Upper 2nd Creek, Bulan, Ky was indicted on one count of flagrant non-support for his two children in the amount of $7,198. on Jan. 22, 2010, a Class D felony.

David Perry, 27, of Rose Ridge Road, Olive Hill, was indicted on one count of flagrant non-support for his minor child in the amount of $6,960. on Jan. 22, 2010, a Class D felony.

Larry W. Porter, 51, of St. Hwy. 55, Olive Hill, was indicted on one count of possession of a firearm by a convicted felon by possessing a pump shotgun on Oct. 28, 2009, a Class D felony.

Christopher A. Bradley, 18, of St. Hwy. 1626, Olive Hill, was indicted on one count of receiving stolen property by receiving a 25 cal. Pistol knowing it was stolen on May 5, 2009, a Class D felony.

Jeff Spillman, 30, of Carter County Detention Center, Grayson, was indicted on one count of flagrant non-support for minor child in the amount of $1,280. on Jan. 22, 2010, a Class D felony.

Jeff Spillman, 30, of Carter County Detention Center, Grayson, was indicted on one count of flagrant non-support of two other minor children in the amount of $4,212. on Jan. 22, 2010, a Class D felony.

David J. Caudill, 33, of Carter County Detention Center, Grayson, was indicted on one count of flagrant non-support for a minor child in the amount of $2,917. on Jan. 22, 2010, a Class D felony.

Corey J. Wicker, 25, of E. Fifth Street, Grayson, was indicted on one count of theft by unlawful taking by taking copper wire valued over $500 which belonged to Fifth Street Electric on Jan. 12, 2010, a Class D felony.

Jamie Downing, 27, of Wolfe Creek, Grayson, and Brittany Lewis, 22, of Wolfe Creek, Grayson was indicted on two counts including, 1) theft by failure to make required disposition of property by possessing a 32 LCD TV valued over $500 under a lease arrangement with Rent to Own and selling it to a third party and keeping the proceeds on Sept. 25, 2009, a Class D felony, and 2) theft by failure to make required disposition of property by possessing a Laptop valued less than $500 under a lease arrangement from Rent to Own and then selling to a third party and keeping the proceeds on Oct. 5, 2009, a Class A misd.

Brandon Burnett, 25, of Crossbar Lane, Grayson was indicted on three counts including, 1) first-degree robbery for robbing Guadalupa Cobalaxiu using a pistol on Aug. 23, 2009, a Class B felony, 2) convicted felon in possession of a firearm on Aug. 23, 2009, a Class D felony, and 3) persistent felony offender by standing convicted of a felony after a conviction of one previous felony on Aug. 23, 2009, a Class A felony.

Leslie N. Whitaker, 23, of St. Hwy. 773, Hitchins, was indicted on one count of first-degree robbery for robbing Guadalupa Cobalaxiu using a pistol on Aug. 23, 2009, a Class B felony.

Michael Nolan, 33, of Little Sandy Land, Grayson, and Kathy R. Wilburn, 58, of Northside Apts., Grayson, were indicted on one count of first-degree trafficking the Scheduled II controlled substance oxycodone on Aug. 26, 2009, a Class C felony.

Joseph D. Gembrowski, 28, of Elk Road, Grayson, was indicted on two counts including, 1) first-degree trafficking, second offense in Scheduled II controlled substance oxycodone and having a prior conviction for trafficking in a controlled substance, first degree on Oct. 27, 2009, a Class B felony, and 2) third-degree trafficking, first offense in the Scheduled IV controlled substance Xanax on Oct. 27, 2009, a Class A misd.

Brian Keith Burnett, 36, of Hancock, Grayson and Roger Anthony Burnett, 42 of Grayson were indicted on one count of second-degree assault by intentionally striking T. E. B. with their fist and feet and causing serious injury to him on Oct. 26, 2009, a Class C felony.
