unfortunately the law does not work that way. He is going to have to prove with out a doubt shooting him in the back of the head was the only possible way to get Sam off if his kid. He will have to make a choice either plea deal or leave it to the hands of jury which if convicted could get life in prison. One little detail that is going to bite him in ass is him having alcohol in his system that impaired his judgment. Either way Sam is dead and Brickey is in jail and a lot of lives have been affected by this.

An Afton man charged with second-degree murder was scheduled to appear today in General Sessions Court.

Ronald Eugene Brickey, 49, of 1760 West Pines Road, was charged early Saturday following the death of Samuel Eanes, sheriff's Detective Sgt. Jason Taylor said in a report.

Brickey "did knowingly kill" Eanes by shooting him in the head with a 9 millimeter pistol, the report said.

The shooting happened at 1760 West Pines Road.

Sheriff's Steve Burns said this morning that the victim and Brickey knew each other.

Eanes and a woman had apparently been invited to the house by Brickey before the shooting, Burns said.

Alcohol use was an apparent factor in the shooting, the sheriff said.

"They were acquaintances, and they were invited there (and Eanes and Brickey) got into a dispute. Alcohol was involved, and it resulted in one being killed," Burns said.

Deputies were called to the scene at 12:41 a.m. Saturday, Burns said.

The alleged murder weapon was recovered, Burns said.

Brickey is an employee of the Washington County Highway Department, according to the arrest report.

Bond for Brickey was set at $250,000 pending his court appearance today.

I am glad you are optimistic but people in the real world know when you shoot someone while impaired on drugs or alcohol your defense seems to weaken just a little bit. I hope he can afford a good lawyer (if he cant afford 25,000 for bond then I doubt it). The DA is going to shoot (no pun intended) holes in his story.

This forum cracks me up! Seriously people? I know that he was assaulting someone on Sams property, so Sam shot him. He was warned that he would be shot. To me, he was trespassing. If you come to my property, making threats, I WILL Shoot......I hate it ended in death and both families will be paying the price. Its a sad sad situation.

FACTS: He invited Sam over to drink (read the report Brickey invited him). Brickey was intoxicated (in the report). Brickey shot Sam Eanes in the back of the head. You can have a million people testify for Brickey it doesn't mean he will go free. If this was a self defense case he would not have been charged for second degree murder or his bond would have been less (250,000 is not much its based on your assets and income)but it looks like the judge wanted to make it hard on him.

Sam was not shot in the back of the head, that is FACT. It is the job of the DA to site anyone with the highest charge possible. The newspaper article ( no matter whom is making the satement in the artical ) is not an official report. It does not matter if one is invited into your home or not nor does it matter if you are impaired in any type of way, you have a right to defend yourself or a third party in your home against bodily harm or intent to take your or a third parties life.

The job of a DA is not "to site anyone with the highest charge possible" their job is to charge the person with the crime that fits the situation. The charges fit the crime, the crime is murder the charge is second degree murder probably because all the parties were drinking. It really doesn't matter because in the long run Brickey will plea bargain and probably get 10-12 years.

No one deserves to be shot in the front of the head from a foot away with a 357, especially a person with no weapon on them and laying on back. Sam went to the man's house that day and dug a big ditch for him. Should be first degree murder and $500,000 bond.

Brickey choose to shoot him in the front of his head while he was laying on his back and Sam was unarmed. If you shoot someone in the head you mean to kill them. Which is First degree murder. You can shoot them in the leg, arm, body, foot anywhere but the head. Any person in their right mind would not shoot someone in the head - he is a murderer. It should be First Degree Murder and he should never get out of jail.

His son was bigger than Sam and did not have a scratch on him, if you are suggesting he was protecting him. I saw him the next day. There was a young child there and it didn't bother Brickey to shoot someone in the head and a young child saw it.. They all were invited into the home. I also know the ex girlfriend and she was not in the hospital from Sam. She will tell you that. She went to a hospital but, not for her body. You can shoot a person anywhere in their body. So, don't act like he was an angle when he murdered a person by shooting him in the head. He needs to stay in jail for the rest of his life. Would you like to have a signed petition with thousands of names stating this fact..........

Sam did not go to work for the Brickeys. Sam was his own weapon. Sam is much bigger than the son. the sons wt. is about 125-130 lbs. The son also has a meek and mild personality. This how incorrect info gets started. get your facts straight.Pro Brickey Help us get Ronald out of jail. you didn't sam.
