Hawk should ask for a bench trial and waive a jury trial. Don't plea to domestic assault. If Hawk is convicted of the felony or domestic assault he's out of office via Constitution. Hawk's ace in the hole is federal judge's finding against Hawk's wife that she lacks credibility and is more than willing to manufacture evidence. At the very least, if Hawk is convicted at a bench trial he can appeal on a very credible basis. His wife's lack of credibility is reasonable doubt.
Don't understand why he wouldn't want a jury trial. It would be citizens from Greene County. That's the same people who put him back in office. If he does a bench trial, most seasoned judges know bull when they hear it. That could lesson his chances. Then again, judges are human and can be bought, know matter what people think. A human judge has way too much power on earth, but on earth only. Thank God!

A federal judge has branded a woman now accusing her legislator husband of domestic violence a deceitful trickster who cyberstalked an ex-husband, doctored emails to make it appear he was an adulterer and secretly changed a prenuptial agreement.

U.S. Magistrate Judge William B. Carter has issued a ruling in which he assesses Chrystal Goan Hawk $20,000 for violating state and federal wiretapping laws in connection with her prior marriage to Greeneville millionaire James Roy Klumb.

Crystal Hawk is now the wife of state Rep. David Hawk, who represents the 5th District, and, in March, accused him of hitting her and knocking her to the ground. That charge is pending.

Rep. Hawk has insisted his wife was the aggressor, pointing a gun at him as he held their baby daughter. A hearing on the charge was postponed to Sept. 11, well after the Aug. 2 primary in which he faces three Republican challengers. His wife is an attorney and president of the Greene County Republican Women.

Crystal Hawk was fresh out of law school when, in 2004, she began dating Klumb, a Greene County businessman whose family business holdings include the Klumb Lumber Company. The pair wed in 2006.

Both, according to Carter's opinion, were worried about infidelity. Klumb asked Crystal Hawk to draw up a prenuptial agreement to protect his family interests in the event of a divorce.

According to Carter's opinion, Crystal Hawk drafted two one meeting her husband's wishes and signed by him and a second that would give her a big chunk of her husband's assets should he cheat. She also drew up two versions of a related document and had her lover, attorney Todd Shelton, take the version benefiting her to be signed off by a judge. It did not appear from the opinion that Shelton knew that document had been altered.

Carter wrote that Crystal Hawk also secretly installed spyware on Klumb's work computer and diverted email between Klumb and another woman. The email was innocuous, but Crystal Hawk doctored them to make it appear the pair was having an affair, according to Carter.

Although the couple eventually reached a divorce settlement in which Klumb proved the financial victor, Klumb via defense attorney Hugh Ward sued his now ex-wife for violating wiretapping laws through the use of spyware on his computer to snatch his emails.

Carter called Crystal Hawk's actions "extreme and outrageous." She also has to pay Klumb's legal bills.

No matter what was said and done before and during their marriage, Hawk had no right to physically abuse Crystal. This is what the main focus of this is all about. The real issue here is domestic assault by an elected official, not Klumb and Hawk's sad attempts to put the focus elsewhere.

I agree, because if we start looking at pasts, then we must measure David's as well and his two prior wives. The focus is what happened that night/morning. Something made the grand jury heighten the charges. Everyone deserves to know what.

The question I have is assuming Hawk punched her in the head, then what did she do to get her face caved in? I'm sure Hawk didn't just walk in the door and decide to smack her down.

You are assuming a woman has to do something for a man to strike her ? That's not always true, and some men are naturally insecure and have a temper.

Google hawk and rep mike turner, or read the link above. It appears as if he has always had a temper. Ironic that the Greeneville Sun didn't run the article, but the biggest paper and station in Nashville did. What does that say about our paper? One sided? Do you think you get all of the story or what they want you to know?

I applaud Hawk for standing up for students and facing Turner, who was obviously the aggressor. A state rep that takes up for the teachers unions and disregards the best interest of students needs to have the shit kicked out of him. I have never met Rep. Turner, but if I ever do, I will strike up a conversation on this issue and if he would get in my face, which he probably would know better, it would be a quick lights out for him. And as reference, I was a Marine for eight years and worked for Blackwater for six. Further, I now do consulting and have spent some time with legislators in Nashville. Maybe a follow up to see Turner is in order.

That's an interesting take on things. Turner was upholding teachers rights. They are the backbone of our community.

Turner was holding to his ties with the unions and the unions don't give a damn about education, they just jockey for continuing power and buy the voice of legislators, such as Turner. Quite sickening.

I am sure many would. The unions are a powerful beast with tons of money (that they suck like leeches from teachers) and they've brainwashed a good number of teachers into believing that they represent their best interest (education is rarely a topic). Watch the documentary "Waiting For Superman", which is probably on Netflix or you can grab it for a buck at Popcorn Video.
