Ouster Lawsuit Filed Against County Clerk Thompson

An ouster from office lawsuit has been filed against Greene County Clerk David Thompson asking for the immediate suspension from his duties, and that he be removed from office. The suit was filed by Suzanne Cook less than thirty minutes after she was approved as the Attorney Pro Tem for Greene County. The suit alleges misconduct in office that was detailed in last week's Ethics Committee meeting of the County Commission, and was further discussed in this morning's meeting, most of which was conducted in Closed Session.

Cook originally had been retained by the Insurance Committee to investigate the claims made against Thompson in the filing with the EEOC, and she outlined several of those claims last week. She added that additional allegations were raised during her investigation. This morning, the full Commission met to discuss hiring Cook, and approved that motion by a vote of 13-6. We'll have more on that meeting's outcome in just a moment.

The suit filed today alleges several areas of misconduct, including that Thompson had a relationship with three employees, two of them simultaneously; that Thompson engaged in sexual overtures, electronic communication with sexual requests and content, and engaged in sexual acts in the Clerk's office, during regular business hours, and on tax payer's time. The ouster suit also claims that Thompson created false or altered timesheets for payment of time not worked.

The suit also alleges that Thompson created a fund of money that was unaccounted for and created from registers that did not balance. The suit says the fund was hidden from state auditors, and that former employees were told not to reveal the existence of this off-the-books money.

The suit alleges that Thompson offered special favors to women, but not men, in the county, including some women not paying fees for various transactions. The suit alleges that Thompson either paid those fees himself, or payed for them from the unaccounted for sum of money collected from overages.

Much of the claims made in the ouster suit are based on testimony provided by former employees. Thompson is also facing an EEOC complaint that he sexually coerced and discriminated against a former employee of the County Clerk's Office, with statements of inappropriate behavior by Thompson made by five other women. In addressing the Ethics Committee last week, Cook said that in a position paper filed with the Equal Employment Opportunity Commission, Thompson had admitted to the allegation of a relationship with three employees of his office.

The suit also says that Thompson may have violated penal statutes relating to theft, forgery, consipracy, and other offenses against the administration of government, and destruction of government records. The suit asks that Thompson be suspended immediately, and if he is found guilty, he be removed from office.

The Greene County Commissioners have agreed to appoint Suzanne Cook as County Attorney pro-tem to conduct an independent investigation concerning alleged misconduct by County Clerk David Thompson.

Cook was appointed during this morning's meeting of the Greene County Commission at the Greene County Courthouse, following a closed session of over one hour which began after Cook released additional details into the allegations being made against Thompson.

Cook had been retained initially by the Insurance Committee to examine an investigation into allegations of wrongdoing by Thompson, and the Ethics Committee voted last week to recommend that Cook be hired as pro-tem. County Attorney Roger Woolsey has recused himself from the investigation due to a conflict of interest created by his representation of Thompson as a county employee.

Cook said during the public hearing portion of the meeting that Thompson allegedly created a secret fund in his office that was kept off the books, and that his employees were forbidden to tell state auditors about the existence of the fund in violation of the law.

Cook said that relationships between Thompson and several employees occurred in the Clerk's office and on taxpayer time, and reiterated her claim that Thompson permitted the falsification of timesheets by those employees.

After those allegations by Cook, commissioner Ted Hensley called for the meeting to enter into closed session for the remainder of Cook's remarks. Hensley's motion carried with 13 of the 21 commissioners voting in favor by a show of hands.

Later in the meeting, the commissioners voted 13 yes, six no and one abstaining to retain Cook's services as County Attorney pro-tem. Voting no were commissioners Rennie Hopson, Hoot Bowers, Phil King, M.C. Rollins, Anthony Sauceman and Jimmy Sams, while commissioner Margaret Greenway was absent due to illness.

Commissioner Wade McAmis abstained from voting, and criticized comments that he had acted unethically by voting to retain Cook during the Ethics Committee meeting after having picked up a petition to run for Thompson's job as County Clerk. McAmis, who said he would not be submitting his petition, stated that he was disheartened by those comments and that he did not appreciate being called out for his vote.

Are these allegations or has their been proof in the findings? Maybe it went undetected because it is the word of a conspirators' allegations. Something about this doesn't seem right...maybe it's the timing. Will these investigations be made by the EEOC and then the attorney acts on them or is she in charge. Forgive me, I do not understand the legal maneuverings of gov't., but something is just not kosher here. Thank you for your input on other posts, I am new here and you seem knowledgeable on things such as the running of this local gov't.

Attorney Cook is not in the good ol' boy network.
I hope she cleans their clocks.
She's pumped more sheet out of that Annex in a month than Roto Rooter pumps in a year.

You don't even know half of the story. You have no idea what some of these women went through. It isn't just coercion. It is harassment and threats. I personally know one of the women and she continually refused to take money from him but then he would blackmail her. She eventually lost her job because she refused to do what he asked. He is an absolute pervert. Also, how do you call a woman a whore when she had only worked there a half a day and went to lunch and didn't come back because she couldn't stand harassment. One of the women repeatedly questioned the time cards but he would tell her it was his money and he just wanted to help. Then later he used this against them and asked what they could do for him. He preys on single mothers who he knows really need their job and are struggling. He is a predetor and these women should not be charged with anything. They are victims of a pervert.

I work in the private sector, outside of the wild world of goverenment. If I had pulled something like this, I would have been fired as soon as it came to light - and rightfully so! If you work for the goverenment (federal, state or local), there is little accountability. We allow for trials, lengthy investigations, etc. It's absurd. He should have been fired months ago, yet we continue to piss away taxpayer money on this guy.

I think you missed the point "who cares". The person you responded to agrees with you. We all want to hear everything that Attorney Cook has to say. We all want the truth. We need to call our commissioners and let them know we're watching and we want answers.
