All the Sun said is that it was bound over to a grand jury. Hiw can this be. It's been since March and just now it's oing to the grand jury???? Out rageous!!!

He presented no defense. To me, being bound over to the Grand Jury is the same as a guilty verdict. He would have proved his innocence today if he could have, only guess what? He couldn't. He has given all Greene County Citizens a black eye. If you vote for him, you will be going to the detention center to talk to your State Rep. The democrats should love all this as this helps assure that Mr. Yokely once again serves Greene County in Nashville.

If it goes before the grand jury, I think it then becomes a state charge. That means it becomes a felony. He is probably shooting for a pre-trial diversion!

And of course, you're right. Just wondering what actually happened. I didn't know that going over to the grand jury was even an option. I wonder why all the stalls and stuff. Almost like its part of a plan....

grand jry meets late nov. if enough evidence then goes to criminal court. he could chose a jury trial. either way, not proving innocence today and getting a dismisal tells me he is guilty as he11. trial will be after first of the year

I guess I have a ton of questions, like why would he ask for a trial today and not put up a defense? Is he concerned about his career and the citizens, or just more bad publicity? I thought it would be a done deal. I thought he would walk today or at least work out a plea deal. Where was the gun? Can he produce a
Gun? So he will go to trial early next year, on new charges? Do we even know what the charges will be? Does he think he will be reelected while facing new charges? I do not know who was advising him, but this is shocking. Simply shocking! Can anyone explain the rationale behind his strategy?

After a preliminary hearing lasting around two hours Tuesday afternoon, State Representative David Hawk's case was bound over to the grand jury.

Hawk was charged with domestic assault following an incident at his residence on March 18 in which he is accused of striking his wife Crystal. Hawk denies the charge and claims that his wife threatened him with a gun while he was holding their child. He has been free on bond since the incident.

Judge James Nidiffer from Washington County presided over the case following the recusal of Greene County General Sessions Court Judge Kenneth Bailey Jr.

Three witnesses were called to testify during Tuesday's hearing. Craig Bowlby, a fireman with the Greeneville Fire Department and an auxiliary Sheriff's Deputy, was the first to testify. Crystal Hawk had called him that morning and then he called to report the incident to the Sheriff's Department.

The next witness was Deputy Michael McDonald with the Greene County Sheriff's Department. He had responded to the scene and investigated the incident.

The last witness was Crystal Hawk. She gave testimony about the incident, saying that David had hit her in the face and knocked her out while she was holding their child on the couch.

David's defense lawyers did call Crystal's credibility into question during Tuesday's hearing, bringing up a recent lawsuit brought against her.

David Hawk commented to Radio Greeneville News following Tuesday's hearing.

The grand jury is scheduled to convene during the last week of November, and a tentative arraignment date of November 30 has been scheduled.

Aaaahhhhh so now I see through the fog. She called a so-called "friend" first! Then he called the police. Hmmm her "friend" know her inside and out too? And the gun,she have a permit to carry? If not then that's attempting to go armed,and assault with a deadly weapon. Credibility? I see no credibility whatsoever.

She called someone other than 911, because her testimony was that she knew the city police would not have arrested him. Apparently she knew this because his exwife had reported him to the city on at least 25 documented occasions and the district attorney and they did nothing. So she is smart enough not to call the city because daddy Buddy, would have gotten him out if it, again.
