Child Support Felony Warrent

Does anyone know of any info on if a person has had a felony warrant taken out on them for not paying child support? Can they be extradited from the state they live in back to the state they owe? Is there a Certin amount of miles to that Jurisdiction that there only allowed to go, from my understanding anything beyond 500 miles they can not. Would the judge take into consideration that the person who owes now is in a better position to pay on time and weekly or biweekly,and is now stable with life.
what about if the children lived with him and it was never reported to child support can that be an advantage on his behalf,or that when they werent with the custodial parent she still didnt report,but yet he sent cash or money cards to the children directly? any information would be greatly appericated.

You need to speak with a attorney! Usually the 1st consultation is free! This circumstance sounds really jacked up! My first question would be why didn't you contact Child Support Services a LONGGGGGGG time ago??!!

He did and told them he wanted to start paying and to have it taken out of the checks,but it never happend,he also informed them that the children were with him when they were and the mother never called to confirm,she hasnt seen the children but once in two yrs and an still pursing support,her parent have had the children but were arrested on child abuse.He has been in a stable relationship,self emplyed and has sent money for the children personally to the grandparents,so wouldnt that look good for him if he were to talk to the judge,at least he is willing to pay and try to make things right,which is more then what I can say about alot of ppl.we are going to contact the agencies on Monday, Im just wondering if anyone else has been thur this and what happened with them?

Okay so he did contact child support services to have his payments garnished out of his paychecks, right? But then you said he told the child support services that the children are living with him? Well, if the children are living with him why would he have to pay child support to himself? Maybe thats why action was not taken to have support payments garnished?

You said her parents were taking care of the children but were arrested on child abuse charges. Where are the children now?

I hope you kept receipts!

So whats going on with the mother? Whats her problem? Why does she not want to have anything to do with her children?

I'm assuming the reason why you didn't get custody of the children since the mother is unfit was because you were unstable?

He had reported when he was working before the children came to live with him,is what I meant.and the children are in State Custody,(that just happened within the past week).and for her she only used the children to try and get him back and when she saw that wasnt going to work she went and dropped them on her parents and left state. and the reason he isnt able to get custody is he was told that he owes back child support to the state,so its not like he hasnt tried to get them with him and the mother has went as far as not letting him have contact by telling her parents not to allow it because he wouldnt send her money for her own use. and the receipts were destroyed in a blding fire,though there is and can be proven that the children were in his home and she refused to report it to the state.He has always wanted his children with him,but the mother wouldnt allow it b/c he didnt want to be with her.

Did he return to the child support office and tell them no action has been done as far as support payments being garnished? Before the children came to live with him?

Who told him he could not have custody of the children?

He was told thur the State child support office where he owes,that since he owes he wouldnt be able to receive custody.and yes he called several times and they sent him paperwork once amth on what was owed and where to send it.and he would call them to let them know where he worked and how to get ahold of the company and cant understand why nothing was ever done,it was like he was lost in the system,until they were ready for him.

Yes, they have went all the way to Iowa to get someone for child support. An attorny is the greatest advice you can be given. One good attorney is Leslie Doubthat I think. She is good but not cheap. She deals in family court cases such as this. good luck to you.

Thank You. He plans on speaking one who can give advice as he isnt able to hire one to repersent him at this time,But wants to know what he can do,as he has changed over the course of the past 4 yrs and dosent allow the mother to manipulate him any longer,we have been told since he has never went to court over child support or had to sign papers that maybe the judge will give him a chance to show the system that is trying and will pay accordingly.I hope that the judge will allow this of him as he does mean well and has always tried to help his children when he was allowed.

If custody was not expressly granted him by the courts he is screwed. I had physical custody for five years and where it wasn't court approved I had to pay over 15 thousand in back support I didn't owe. You can't even appeal it in Tennessee. You can and will be extradited for non-support. The guy you know needs an attorney and a lot of money from the sound of things. If they don't get all money owed he will go to jail. That means all he is behind,they won't take payments on back support with a felony warrant. I know cause I lived it. It sounds like he is in deep shit.

Real Deal, he lives in Tn but owes in another State. so your saying that if he tries to right his wrong,they will still lock him up when he is going to be paying.I dont agree with that,he told that if you look on the bottem of a felony warrent that it states that it has to be within 500 miles of where the warrent was taken that he can be picked up anything further they cant go to extradite. Sorry that you went thur that,but there are vindictive females out like that,and I think its sad that they do such.What good would it do to lock him up when they could give him a chance to start paying and then file taxes and use that mny as well.dosent make any sense to me.

Doing right what about what children could have used past support for yes its great he wants to pay now but that really put kids in a tough spot not having support im sure kids had to find a way and im sorry but I agree with Tennessee court on this one he should pay back in full

He payed in the past and if it didnt go to the courthouse it went directly to the children,or he bought what they kids needed when they needed it.an while he was allowed to be involved in their lives they didnt have it rough I will assure you.I myself have even sent money to the children involved to make sure they had extra.This has nothing to do with Tn Court this is out side of Tn.

Well.that's good for him to care of his kids so many dont. I have friends and in the past without receipt proof it was sent it is considered a gift not support I wish him luck we need more dads to support kids like that get a good lawyer

He is/was a Good dad and would always do for them,as long as he was allowed,its sad that the mother was so vincidctive that she would lie on him and push issues to this point. I am hoping that he will be given the chance to try and show the courts that he is and will continue to pay as he should. right now cant afford a lawyer so he is kinda stuck,but I am going to try and help him represent.

I want to explain to you I am not being mean. The law may vary from state to state and if this gentleman wants to make things right it is commendable. I know from experience the law is not written fairly. When they want their money they will treat you badly. If his ex received any state assistance, which from the sound of things she is the type to want something free, the state will send him the bill. I really hope if he is honest and sincere things will work out favorably for him. They will extradite so don't believe they won't. I know a man who got a speeding ticket in Texas and was extradited to Tenn. over $4000.00 He is in a bad spot and they will lie to him to get him in custody. You need to find out what the laws in that state are. I would bet they want all the arrears. Good luck.

It is my understanding that the Child Support Office doesn't have anything to do with custody or visitation. And just because he owes back child support would have nothing to do with getting custody of the kids. He could get the kids, and still have to pay the back support he owes.

Google Child Support Enforcement, and you should be able to find listings by state for issued warrants.
