Deputy going to trial

NEWAYGO COUNTY -- A suspended Newaygo County sheriff's deputy accused of sexually assaulting an acquaintance in 2002 has waived a probable cause hearing and was bound over to trial in the county's circuit court. Robert Dakin, 37, a force lieutenant and department spokesman, is charged with third-degree criminal sexual conduct through force or coercion. A 33-year-old reserve police officer for another agency said Dakin touched her against her will in August 2002. Dakin was arraigned last month and is on paid leave. If convicted, he could face 15 years in prison.

The truth lies in him and in her but the hurt stretches a lot further can you imagine having to explain this to your children? Wether you like him or not has nothing to do with this! and how would you like reading comments like this about your father?? Make all the statements you like but remember it could be you put in this situation and you would want to be innocent untill proven guilty!
If this happened he should serve his time but the catch is IF!!!!!!!!!!
It is all to strange to me that this is coming around years later!! Something is going on that is not being told in the mean time I think it is repectful to hold Tounge

<quoted text>I can understand why you say this...however, six years is a little ridiculous. I personally think she is a "woman scorned" and upset that maybe this man doesn't want anything to do with her, so now she's going to go to authorities about it. If this guy was harassing her then why would she go to the authorities now...why not 6 years ago? Do you think she just NOW gained self assurance? I think there's a lot more to this story...but I also think there should be a statute of limitations on things such as this. Not only is this man's reputation ruined, but he could also lose his job and do prison time!
I can tell you that I personally know someone who was part of a class action lawsuit against the Livingston County Agency who seemed to have a problem when it came to the female persuasion.

It took over 4 years for "authorities" to admit there was a problem. It took another period of time for an investigation to produce probable cause. By the time a suit was filed in the knick of time,(again class action) the plaintiff who I personally knew, died under mysterious circumstances. The cause/manner of death is still "undetermined". Probably a coincidence as 27 year olds drop dead for no reason every day.

Her friends, family and co-workers/acquaintences have all complained of past undue, unneccesary law enforcement ..ahem.. safety checks. Weird how those stopped once the plaintiff died.

My how ironic that my previous post was judged so harshly and so quickly. Why it's almost overkill over nothing.
This girl is bringing charges as a lone soldier. Not a class action.

Chill out.

Yes you would. It only takes an admission that there is a problem or a witness.

There is a Statute and it just happens to be Six Years for this charge. It's entirely possible the other theories about retaliation being the "cause" for being quiet for this long. It's entirely possible she kept mum in hopes that he would no longer be on the force when she decided to come forward. Now that she's up against the timeline, she has no choice about having to come forward at this time other than to keep quiet. All of this is speculation and it sure does "feel" like there is a heckuva lot more to it than we know
I definitely agree about the speculation aspect. I just don't think it's right to slander someone's name through the mud unless there is 100% evidence he did this. IF there are other women he apparently touched...they should come forward too. However, I feel this story needs to be dug deeper into...

Actually, there is no longer a statute of limitations on CSC charges anymore.
Which is absolutely LUDICROUS! There needs to be SOME sort of limitations in place. Even if a child was say 10 or so...give them enough years where they could come forward and expose the person...not a while lifetime!

I been grabbed a few times by some drunk females at party's.

First off...I am sorry that the person you knew has passed away with unknown causes...yes it is quite ironic how she died while during a class action lawsuit. However, there have been women known to lie because they don't get their way. My Uncle and his wife used to take in Foster daughers who were around the age of their own daughters. A couple of the girls were really angry that they couldn't get their way and had to obey rules...so instead of just abiding by the rules, they decided to concoct some story and say my Uncle had been touching them inappropriately. My Uncle could have went to prison, lost his job, and his family had this not been properly investigated by the police. Of course the girls finally fessed up, but the point is, someone's life could have been ruined. This Deputy's name is being slandered through the mud over this story. If the woman was SO scared she should have went to a different police agency or a judge or SOMEONE she trusted SIX years ago and talked to them about it. If he apparently did this to her, then he most likely would have done it to other women...and no one else has come forward (yet). I think there's a LOT more to this story...and I am chilled out...thanks!

It's ironic alright. Not that she died, but that she died with no determinable cause, rhyme or reason based on the timing. Statute of limitation and all.

Sorry for your uncle if he's really not a perv. Who's to say he isn't? Depending on the county would largely depend on if the "investigation was proper". Enough on that.

You said,
"If the woman was SO scared she should have went to a different police agency or a judge or SOMEONE she trusted SIX years ago and talked to them about it."

The next police agency would be the MSP. They will take a report, depending on who you are and who you know, it doesn't mean it will reach a prosecutor. You can "trust" Santa Claus, but it doesn't mean he has the answers.

Remember, police have better lawyers and resources thru their union. Right or Wrong.

This woman may be in the wrong, of course. But if she isn't, there may be an explanation as to why it took so long.

That's all I'm saying.

My Uncle honestly isn't a pervert, those girls were just so gung ho on getting their own way, they didn't care who was in the way. Apparently their former foster parents had given them back because they tended to stretch the truth a lot.

As far as Police having better lawyers, this is true, but when your in a Union, the lawyers will not ALWAYS cover you. I work for the MDOC, and they will NOT cover you under certain circumstances. Unions don't always have your back, just so you know.

She could have went to a different police agency, not just the MSP. She could have told them her story and asked them to contact the proper authorities and explained that she felt "threatened or intimidated" but she did none of the following.

I do see your points, but I also hope you see mine.

You must not be familiar with Newaygo County. Even a honest police officer doesn't know where to turn to for help when it comes to who you can trust.

No, but she could have went to a trusted friend or SOMEONE she trusted who could have gotten her the help she needed. Not all police officers are bad...and SOME women like to cry about what happened many years later when they could have spoken up right then. I definitely think there is more to this story...and I hope they research her past to see what type of person she is (if she's a habitual liar and so forth). I don't think it's right for people to drag the guys' name through the mud until he's found guilty of the crime he may have committed. I think it's pathetic that someone waits right up until the statute of limitations is almost up... something smells fishy there...

Wendy you are completely missing what I am saying.

Newaygo County there is no where to turn. I am sure the victim confided in someone but what are you to do? If you had any idea of the cover ups involving police officers in Newaygo County and this officer in particular you would understand.

I do see your points, but I also hope you see mine.
She could have went to Mayberry PD who would say "Did you contact the State Police?"

One county doesn't have "jurisdiction" over another counties police dept. or it's officers behaviors. Neither does a Twp. police dept. have jurisdiction over other twp or county departments.

The next in the chain of command (proper authorities) is the MSP. Reporting to them doesn't mean it gets prosecuted. MSP may not even review it until you can satisy that you complained to the agency where the alleged offender originates and nothing was done at that level.

Complaining to the agency who employs the alleged offender doesn't guarantee an internal affairs investigation beyond "Did you do this as alleged?". The complainant may not receive correspondence that an investigation took place or what the results were. So.....it's right back to square one.

The only exception is now you are KNOWN to be a snitch who is making waves so retaliation is more likely than if you just kept your mouth shut. How is that fair?

If you continue to persist the list of your associates who may get targeted for retaliation might just grow to include innocent bystanders. OR you could always wake up dead.
