We should leave tobacco smokers alone then and let them smoke in their homes, cars, bars, restaurants and any other public place since MJ smoke has toxins too...... Second hand smoke and lung disorders will have the same outcome......

Since they were so kind as to eliminate any kind of pre-existing penalty, there's nothing to stop people from playing it exactly like that. The tax penalty for not having insurance is a pittance compared to paying the premiums. Only a fool would do anything less than what I outlined above.
