States do not get to have discriminatory laws without some rational purpose. They are overseen by federal courts in this, judicial, sense and always have been, you trash.

States did control marriage until the Congress passed DOMA. DOMA took various aspects of marriage away from the purview of individual states and made it federal in legislative terms. Go blame those DOMA homophobes in Congress, Jedediah.

There is no need for a marriage license for a religious wedding. Many gays and lesbians have had them even when SSM isn't legally recognized.
