Records: Man drinking before fatal stairway fall

Records show a 36-year-old West Michigan man had been drinking before falling to his death from a winding staircase at a Grand Rapids nightclub.

I'm pretty sure you'd win on that one. At that point, it would be disorderly, possibly even trespassing. If s/he then left the premises attempting to drive and it was witnessed by the police it would be OWI. Either way the homeowner wins.

Did I say that? No I did not. All I am saying is that if the business owner chooses this type of business to go into, then he also takes on the risk.

So, if a car dealership sells someone a car, and that person gets in an accident with said car, they should be able to sue the dealership that sold them the car.
Those car dealership's should know that sometimes people die in cars and they should stop selling them.

Maybe the guy's family should sue the shoe company that sold him the shoe's he was wearing? Were they Nike's?
After all, if your going into the shoe business, you should know that someone wearing those shoes might try to jump over four flights of stairs in them!
And then there are those #2 pencils!
They can poke an eye out!
Those people should know that, and stop making them.

In effect, you did. The flip side of your argument is that if someone choose to go out drinking, they also take on the risks involved.
