I did not say my children didn't have civil rights, it just seems to me that too many parents look the other way when law enforcement has to do their job of disciplining their children. You are taking my comments to the extreme and suggesting that my children should be taken away for it...maybe you are just an extreme person - but really you know nothing about me, my children are very well taken care of, and if anything I think the children are usually the ones that get crapped on in this country - I personally think there are alot of people that should not have kids...at the same time you cant deny these kids were drinking - the parents are responsible for this - and they are saying the school should never have given them a breathalizer.

Law Enforcement has not intention of "disiplining" children in a product manner, they are simply out the make arrest and get convictions, they do not care if you childs life is ruined in the process.

Im am sorry if i went to an extreme in that last post. I get worked up when i see people are unaware of how devious law enforcement officals can be.

From everything I've read and heard so far, the police officer at the dance did invade the privacy of those kids and violated their civil rights. If he administered the test to a student over age 18 and they tested positive for alcohol consumption, he should have made the arrest. If the student was under 18 and tested positive, the parents should have been immediately called and the child picked up from school. I don't see that either of these things happened. It appears that the officer used the test as a form of harrassment, something not uncommon for Cheektowaga Police to do- they have a history of being "heavy-handed" in these situations. If the Superintendent intends to use breathylizer tests in the future, EVERYBODY should be tested as a condition of entry. Or, don't test at all. Furthermore, the school should be using Ion scan technology, which is less invasive of one's privacy and more appropriate in a school setting, much the same as a metal detector. Hand-picking students (especially based on the information of a "snitch") to be tested is a form of harrassment and a violation of civil rights, unless the officer has "probable cause," that is, he personally observes drunken behavior. If my kid ever ends up at JFK (and God-willing he WON'T after this fiasco), and they try to administer a breathylizer test, they had better call me first...

and if one of these kids got behind a wheel and killed someone their parents would be the first ones running and blaming the school for not giving them breathylizers or having proper "security" at the dance. unreal.

Here it the Bottom line kids, no matter what the "school" says you have civil right, when questioned by an officer, you take NO TESTS, YOU ANSWER NO QUESTIONS....
You simply state RESPECTFULLY...
"Im sorry i do not have council (lawyer) present therefore I cannot any any questions and will not consent to any personal searches."
Trust me, the cops are not going to "let you go" or take it easy if you cooperate, they will use everything you say against you as a "cofession".
It is assumed you know your miranda rights, so they do not have to advise you of them. The school officeral are NOT ATTORNEYS and have no legal education therefore cannot advise you and connot force you to submit to any tests or questioning.
The PIGS will try and trick you into talking by saying "if you cooperate it will be easier".....it will only be easier for them to get a conviction in court. THE POLICE ARE NOT YOUR FRIENDS...they are your enemy and they ARE PAID to be out to get you.....
And if the Superintendant is reading this.....up yours....how do you like that...chump

And the parents would be wrong. Why should the school be blamed for that? It's not the school's job to raise our kids. And as I said before, if it is necessary to monitor kids for alcohol consumption at school functions, test EVERYBODY. Ion scanners are quick, easy, and effective (but not cheap). Slightly more inconvenient than walking through a metal detector. But again, this shouldn't even be an issue. "Parenting" and "personal responsibility" are the issues. I don't expect the school to "parent" my child. I DO expect them to call me if my kid "screws up," so that I can mete out appropriate punishment.

From what I've been told, the "JFK 8" were "targeted" due to their status in the school, while many more inebriated kids were at the dance, but went undetected. If they're going to test for alcohol, test EVERYBODY. If the students know everybody will be tested at the door, they will most likely be sober, or not attend at all. Problem solved.
