Police say fatal crash on I-190 caused by drunk driving

He was killed just doing his job on the 190 south near the 290 interchange. Capt. Michael Nigrelli, NYS Police, "It's a dangerous job.

again, how do we know he got drunk at the casino and not in his car or someplace else? Are casino's and restaurants/bars responsible for babysitting these people who can't handle their liquor. I don't think so. Brown is the only one responsible for his actions. I agree with Steve.
I am sure the casino is investigating it already. Maybe sue the cocktail server or bartender instead. They should know better, right?

As a matter of fact, YEA, the servers should know better and if a person seems intoxicated they should not serve them anymore! Instead of being concerned about how big of a tip they're going to get! An FYI..We know Mr. Brown was drinking at the Casino BECAUSE HE SAID SO EINSTEIN. Why don't you and Steve go have a drink because you both are taliking out of your behinds!

Isn't there a law that states that a bartender and/or server can't serve another drink to an obviously drunk patron? Am I mistaken?

I am so sorry for your family's loss. This tragedy didn't need to happen. I'm sure most of the community agrees with my sentiments that we are truly sorry for your loss. I'll keep Kevin's son and the little boy's mother in my prayers.

The company that I work for will be at the service for Kevin tommorow and I hope other tow truck ops. from the area will be there as well to pay there respect to young man whos life was cut way to short. I also call on the Erie county D.A. Frank Clark to not back down and try the man that is at the cause of this whole thing for all the charges he has been charged with. He did not care for any one but himself when he got in that truck drunk. Kevin was given no deal when David Brown Killed him, you (Frank Clark) should not be giving any deals to Mr. Brown!

I to am a tow truck driver and if ANYONE THINKS THIS IS A SAFE JOB JUST PULL OVER ON THE SHOUDER OF A MAJOR HIGHWAY AND STAND THERE AND TELL US HOW SAFE YOU FELL AS SOMEONE PASSES YOU DOING 60+ MPH JUST INCHES AWAY FROM YOU it is way over due to have a law on the books that means something that you must move over one lane when you see any flashing lights on the road if you see flashing lights that means someone is doing a job and there are close to those lights to many cops,road workers and other rescue personal have been hurt or killed because of this. Now for the man who killed one of our towing brothers you drink you drive you kill someone it is MURDER NOT MANSLAUGHTER AND SUBJECT TO LIFE IN PRISON OR THE DEATH SENTENCE .My thoughts and prayers go out to the family .

Ever see a tow truck on the side of the road? With all of the flashing lights? Nothing could be more obvious. A huge truck, with flashing lights with a car being loaded onto the back.

This guy was wasted enough to drive RIGHT into this. He hit the car, Kevin, and the tow truck. That's how intoxicated he was when he CHOSE to get behind the wheel.

No, I don't think it's too harsh to say that this guy has his own life and will feel bad. The only thing this guy will feel bad about is being punished. If there was no punishment I doubt he would even care as he felt the pressure of lawsuits and jail terms being lifted from his shoulders. He should be charged to the fullest extent of the law.

There is no defense for his actions. This guy didn't have "a drink or two". He totally missed the fact that a tow truck was on the side of the road. Now a six year old has to grow up without a father.

Lori, your comment about legalized marijuana has no place in this. Someone's son, father, fiance, gets killed and you use that as a spot to push for legalized marijuana? That's disgusting.

I went to school with Kevin, he was always a good guy. My best wishes go out to his family.

Well, GEE Thanks GABBY!
I like to move around from machine to machine when I gamble. Every time there is a DIFFERENT cocktail server. THey wouldn't have known how many drinks I might have drunk that evening. And I may act sober too, but might not really be sober enough to drive home. They really can't tell if there is a different person serving me every hour. DUH!

OK, if anyone is still interested in this case, FyI The driver's Blood Alcohol level was barely over the legal limit. He wasn't intoxicated drunk for a server to know he's had enough. Just goes to prove my point... Anyways, onto the next DWI case. Thanks for hearing me.

To an extent bars and restaurants are always liable in cases like this. Its like the story of the millionaire who was hammered and spent millions in AC. He sued and got some of his money back, this is way worse of an incident.
And I am tired of people saying the casino is not able to be sued because they are sovereign. What are these people not governed by the laws of the land they live in? So I can commit murder or a crime and get away with it on the casino property or the res? Thes people take it too far! I guarantee they can be sued. They still have to answer to federal laws and courts, by which they are us are all ultimately governed. Find the right lawyer and I am sure there is a way sue them if they so choose. Maybe they shouldn't be dumping free drinks down peoples throats or their skanky waitresses should be trained when to cut people off insteaded of being so worried about that extra dollar tip. The casino is supposed to offer free rooms or taxis to patrons that are too drunk to drive its their responsiblity I hope the family sues the crap out of that shit hole of a wanna be casino run by corrupt businessmen. They had their land taken 200 years ago. Ok get over it! If anyone still has a grip about anything it should be the blacks who were slaves for all those years. Geez

To all the people that is so hard on Mr. Brown yes it was wrong for what he done,but who are any of you to judge anyone you don't even know this man. Well i do and he raised me he has NEVER done anything wrong to anyone! That doesen't make it rite what happen but if you knew him like i do you wouldn't say these things about him he's the BEST step father a boy could ever have. So don't do Jehovah's job do your own he should have to pay not to the Gov but to God. Because they can't bring the man back but God can.
