I like Mr. Tobia am entitled to an opinion. While I am not a lawyer, I can read Government Code Section 1090 and form my own opinion.
Gov Code 1090 "Members of the Legislature, state, county, district, judicial district, and city officers or employees shall not be financially interested in any contract made by them in their official capacity, or by any body or board of which they are members. Nor shall state, county, district, judicial district, and city officers or employees be purchasers at any sale or vendors at any purchase made by them in their official capacity. As used in this article, "district" means any agency of the state formed pursuant to general law or special act, for the local performance of governmental or proprietary functions within limited boundaries. "
Nick Conway (dba Arroyo Seco Associates) provides management and administrative services to a joint powers authority (SGVCOG) and is paid a monthly, fixed price retainer for its work. As part of its duties, Nick Conway manages the activities both of subcontractors to the joint powers authority and/or other public entities who work on publicly funded grant programs that are awarded to the joint powers authority.
Nick Conway gets additional reimbursement for its management activities associated with the grant programs. Nick Conway identifies grant programs to be pursued by the joint powers authority and prepares the grant applications and is compensated by the joint powers authority for doing so; and Nick Conway develops his own scope of work and proposed compensation amounts in connection with the grant programs, negotiates those matters directly with the grant funding entities and subsequently recommends the scope of work and compensation amounts to the board of the SGVCOG as part of the board’s grant approval process; and Nick Conway then manages the grant programs on behalf of the SGVCOG.
That would appear to violate both State and Federal Conflict of Interest laws, and places all San Gabriel Valley COG member agencies AT RISK for the recall of Grants Administered by the SGVCOG. That is an unacceptable risk to my community. Conway's conduct is unacceptable and does not meet ethical standards required by my community or City Council. It also places him in breach of his Management Services Agreement. Since the SGVCOG governing board failed to correct this, I recommended that we suspend our membership in this organization.
It is what it is....and I don't find that hard to understand. Tobia sounds suspiciously similar to Conway...almost word for word. One has to wonder why anyone would spend tens of thousands of dollars spreading deliberately false and misleading information.

Many residents of ther SGV are hoping that a RICO indictment against Nick Conway and the gang of public employees and elected officials will be coming SOON.

Along with arrest warrants for each and everyone of them.

I sincerely hope that the F.B.I. has saved time for Nick Conway and the cast of sgvCOG'sters at the buffet line.

It would be a great New Years present for the taxpayers of the entire San Gabriel Valley maybe even the whole state of California!

Just round up all those who helped Nick COnway for all those years, from each city involved.

Just squeeze'm like a grape, they will squeal just to save their own hides and whats left of their political careers.

Just round up all those who helped Nick Conway for all those years, those appointed or elected officials from each city involved.

The likes of Douglas Tessitor and Gene Murabito are staunch supporters of Nick Conway of the sgvCOG, because they empowered hima nd he inturn gave them cheap political power in Glendora, California.

I am really looking forward to the trial taking place to expose the dirtbags who started all of this.

Let's hope for a speedy trial and conclusion for justice, so we can get set up the firing squad up quickly and then get back to business here.

Come Valentine's Day 2013 Nick Conway (sgvCOG) should find out if he "swings" in court. Many people are watching this very closely for the fall out could hurt or cripple many a political a career, fortunes are to be made and lost over this one.

I wonder if after Nick Conway is convicted the DA will ask for a forensic audit.

I can't imagine they won't want to run a legal root-rooter through there.

It couldn't have just been Nick Conway by his lonesome.

People like Douglas Tessitor and other on the Glendora city hall staff are guilty, even those who have retired and or moved on to another city.

No statue of limations, if they are contacted they will sing to keep what they have.

You heard it hear first Lake a water board director is trying to sneak in a hearing to give Baldwin Park city a free 165,000.00 dollar hookup charge for the transit center. Then she wants the water department to not charge the city for standby charges monthly.
I want to remind Lake it is election year and Lozano and Garcia can not vote you in and when the water companies customers find out your doing buddy deals with the bankrupt city you are gone.
I will be watching who votes for the free money to the city and I know Lake, Pacheco, Macais, and Woods are all up for election this year. This will be a big factor on who gets elected In November 2013.
Once again the crooked sgvCOG is busy giving away money that doesn't belong tot hem, what do you say Nick Conway.
But instead to pay off another crooked politician.

Van De Kamp must have pulled some political strings to get this slop bucket of a politician out of the line of fire of California's legal system?

Nick Conway is the slithering worm that needs to be hooked and landed in prison.

Didn't Van De Kamp represent the city of Vernon? Yep and he slid them off the hit list too!

The Los Angeles D.A. can re file new or old charges with supporting briefs, July 2013.
