Ebay Guardrail, Ebay Quick Decline, Purge of 15,000 Sellers

Ebay blocked 15,000 sellers from listing two weeks ago in their latest purge. The weapon of choice in this elimination of sellers was Guardrail or Quick Decline which targets small sellers with a few low DSR ratings and then accelerates the fast track to restriction and suspension. It's ebay's latest egregious action in its continuing effort to get rid of the mom and pops.

Ebay's tactics towards small sellers: In 2008 John Donahoe (CEO) made it clear he wanted to move away from a flea market operation to brand name big box retailers. With numerous policies that were enacted to eliminate small sellers (chief among these the flawed DSR system) he has been succeeding with a vengeance. 1) The DSR system adversely impacts small sellers more swiftly and egregiously then it does the favored big box and high volume retailers. 2) 15,000 small sellers were axed by ebay on August 6, 2013. 3) The automatic five-star DSR glitch/malfunction that ebay has admitted not fixing was responsible for at least some those purged getting purged because many were only out of compliance by one DSR star 3) The elimination of the policy compliance feature on the seller dashboard. If anybody thinks that was not purposefully done to hurt small sellers, I have some acreage on the moon I will sell you 4) ebay's latest user agreement update that goes into effect October 26 granting itself permission to hide sellers' listings. The majority of sellers on the ebay discussion boards think ebay has already been hiding sellers' listings 5) Ebay's numerous moves in past user agreement opt ins or opt outs to try to insulate or protect itself from class action lawsuits 6) this new managed returns issue (see new user agreement) 7) the fee hikes 8) the misuse/abuse of the DSR system and Guardrail or Quick Decline and trending to rob good decent sellers of TRS status and discounts they would get as well as to restrict or suspend them.

... the watchword is "eBaygate", but I say the regulatory agencies don't work right on big business. They turned a blind eye on Madoff, AIG, Enron, and they will not stop whatever eBay is up to. On a smaller level, the book place confirmed what I knew n 2005: eBay will continue to squeeze small businesses out with niggling fees and excessive delays. eBAy is not the startup little guy any more. Any semblance that they are for the independent small businessman was sold out years ago. Look at what happened with Paypal."

It is ILLEGAL for a corporation to allow a glitch or malfunction (the automatic five-star on shipping DSR for instance) that adversely impacts a user (many of those "purged" were only out of compliance by 1 star) to continue for an extended period of time without fixing it (ebay did and has admitted this, see Ebay Drags Heels In Fixing Automatic Five-Star DSRs article by Ina Steiner on EcommerceBytes.com ). This is a BREACH of the user agrrement that ebay has with the users affected by this. PAYPAL HOLDS; many (if not most) states do not allow a hold on funds of more than 10 days. Ebay has often slapped 21-day holds on sellers' PayPal funds. A Florida man contacted the banking regulators in his state, they contacted Paypal and got his funds released. Although PayPal is not a bank, it is a money transfer entity and as such falls under the banking regulators of each state. UNLEVEL PLAYING FIELD: As has been pointed out by many people in many threads, DSRs disproportionately impact and are used against small sellers while big box retailers such as TOYS R US remain essentially untouched. That's also ILLEGAL. A good sharp legal mind needs to look at what's going on at ebay (including the user agreement). Attorneys generals' offices are very good at that sort of thing. I am not an attorney, but like many on here I am sharp enough to know when there are some things amiss.

From the SEATTLE TOPIX FORUM, the following post: Anon from Toronto: "All sellers that have been abused by ebay, suspended unjustly by ebay, stolen from by ebay, etc, can all do something to get the word out to the entire world about the criminal activities of ebay that are going on under the public's nose, with the complete complicity and approval of the United States government. Your help does not have to require involvement in facebook. The cause is much bigger and much more widespread to limit itself to just facebook.
Many sellers and former ebay sellers are speaking out with youtube videos, blogs, twitter, pinterest, commenting on other people's blogs, commenting on ebay's own discussion boards, and yes, speaking out on facebook's various ebay related pages.
Please help, any way you can, spread the word. Ebay unjustly harmed so many thousands of people that are just trying to feed their families, people trying to pay their bills, disabled people trying to make ends meet, single mothers, etc. The world must wake up to the fact that a site that was once loved by nearly everyone has become corrupt at the top and the entire website is rigged against buyers and against sellers alike. Ebay Inc would have you believe that by using their site, you agree to all their illegal behind the scenes behavior. No company can require you to give up your Constitutional Rights. No matter how many equally crooked lawyers ebay is paying, all that's needed is a few judges to listen and a dose of common sense for regulators to see behind ebay's criminal smokescreen.
Get involved, before the only sellers allowed to sell on ebay are the big companies or Chinese sellers, which is ebay's plan all along.
