Local Funeral Home Fined For Immoral Conduct

MIAMISBURG — A local funeral home and its director are in jeopardy of having their licenses suspended by the state if the owner fails to pay a $500 fine to the state Board of Embalmers and Funeral Directors by Friday.
The seven-member board voted unanimously during its Oct. 17 meeting to charge the Brough-Getts-Staver Funeral Home, 102 S. Second St., and Jeffrey Staver, manager of the funeral home, after the board determined the two parties violated state law by committing immoral or unprofessional conduct.
Staver and the funeral home are accused of failing to secure the death certificate of Mildred Stanko, a former Kettering resident, in a timely manner. Stanko’s daughter Becky Johnson of Westerville filed a complaint with the state board on Aug. 16 about the delay. Board minutes indicate that Stanko died on April 26, but her death certificate was not filed until Aug. 31. State law requires the funeral director to file a death certificate to secure a burial or burial transit permit within five days after the date of death.
Johnson declined to comment specifically on her complaint.
Johnson did say she was satisfied with how the board is handling the situation.
Carl Woerner, owner of the funeral home, said his funeral business is at fault for delaying the filing of the death certificate. However, he said the state’s fine should not be directed at Staver, but at the funeral director who he hired out of northwest Ohio to do Stanko’s funeral.
Woerner, who is not a licensed funeral director, declined to name the director.
“I obviously have no idea of what he is referring to,” said Jennifer Baugess, the board’s compliance administrative assistant, of Woerner’s claim to have had a rented funeral director.“Jeffrey Staver signed as the funeral director on the death certificate.”
If the $500 fine is not paid or funeral officials do not contact the board about having a hearing objecting to the forfeiture, then “the funeral home and Mr. Staver’s funeral director’s license will be suspended until the forfeiture is paid,” Baugess said.
Woerner said he has no immediate plans to request a hearing.“In my opinion, it will get dismissed,” he said of the fine.
The state board had not received a response from the funeral home regarding the fine or a hearing, as of late Wednesday, Baugess said.

i did call them in 2010 to handle the service for my brother when he died. they had handled the service for our mother in 1998. we were disappointed and unhappy with the service. the owner jeff staker was terrible with us and rude with us. he did not show us any compassion at all and we were so disappointed. the big thing was the death certificate was filled out wrong and it took forever to get it fixed and we were held up from taking care of estate things becuase of this death certificate thing with him. other than all that i dont have a complaint but i think you get what you pay for and we did pay less than our friends paid over at the other funeralhome in town. i would use them again but i would look after everything they do to be sure it was done property. my neighbor had their dad over there last year and it was not much better becuase she had death certifcate probelms.
