Officer in child rape case, friend face new sex charges
By George Barnes TELEGRAM & GAZETTE STAFF
GARDNER — A Gardner police officer already facing charges of child rape, and another man who was his roommate, are facing charges of sexually assaulting a 20-year-old woman who was their roommate.
Larry J. Landry, 35, and Tyler Hartley, 20, have been charged with three counts of indecent assault and battery on a person over age 14. They were arraigned Sept. 27, and pretrial hearings are scheduled for Oct. 18.
Officer Landry was charged Sept. 20 with statutory rape of a child, indecent assault and battery on a child under age 14 and assault to rape a child.
The latest charges stem from a Sept. 12 internal investigation of Officer Landry's conduct by Gardner Deputy Police Chief Rock A. Barrieau.
During the investigation, the woman told police that beginning in July and at different times against her will, Officer Landry and Mr. Hartley harassed her sexually. At the time, the three were sharing an apartment at 38 Meadowbrook Lane. The woman later moved out.
Police reports filed with court documents indicate the woman told Deputy Chief Barrieau the first incident occurred a week after she moved into the apartment in July.
A week after that, she said, she was assaulted again and said she told the men to stop.
The third incident occurred near the end of July. The woman said she was lying on a mattress where she slept on the floor next to Mr. Landry and Mr. Hartley's bed.
She said she stayed in the room because it was air conditioned and she needed air conditioning because of a medical condition. She said the two men jumped out of bed naked and sexually assaulted her in a degrading manner.
The woman said that after the attack the two men went back to sleep. She said she could not sleep but confronted them the next day about how degraded she felt. She said she moved out two or three days later.
She said she was afraid to turn them in because she worked for Mr. Landry and his father doing security and did not want to lose her job.
