Is it fair that a 14 year old teen and a 16 year old teen can have sex and yet only the older teen gets felony charges brought against him/her. This is called Unlawful Sexual Relations with a Minor. The age of consent in Kansas is 16. The law states that a child under the age of 16 can not consent to a sexual relationship. If one party of the relationship is 16 or above only the older teen is breaking the law. If both parties of the relationship are 15 or younger both teens are breaking the law and charges can be brought against both. We are talking about a consensual relationship. Both teens have made the effort to have a relationship and have pursued each other.
The 16 year old is arrested and charged with a felony count for each sexual encounter. He/She misses valuable school time and now has a juvenile record to deal with. He/She is kicked off of any and all extra curricular activities at school, a decision that comes from the principal of the school even before a conviction. He/she is placed on house arrest, cut off from all social and family activities. All the while the "too young to consent" teenager is allowed to continue life as they knew; able to go to school and participate in all extra curricular activities, able to continue social activities, etc... Nothing by law is done to keep the "too young to consent" teen from continuing to pursue a relationship with the older teen or any other member of the oppisite sex.
Where is the justice. Yes maybe the older teen "should know better". Maybe the "too young to consent teen" is just a child. We all know that girls and boys are getting more and more sexually aware at a younger age. We all know that girls just as much as boys SEEK and WANT a sexual relationship no matter what age. Although sad where is the justice for the older teen, who is a child themselves.

I think if any person is old enough to have sex law or no law then each individual should have consequences/responsibilities for their actions. Everyone is respsonible for his/her actions .. so I totally agree with you!! But kids shouldnt be so sexually active at a young age but we cant stop everyone but the law should blame whoever is part of an act not just the older of the two.

iI totally agree with you because it is really not fair to the 16 year old boy because not only did he know it was illegal but the 14 year old girl had to have known to. I am also pretty sure that the 14 year old girl could have gone to juvey too and not just let the 16 year old take all the blame for something they both knew was wrong

Just curious? Have you seen this as a written law? What does your attourny say about this? I was married in Wilson county at the age of 15, to an 18 year old. If your counsel is letting this ride, I would seek a new lawyer.

There is more to this story than is being said. Teen don't go telling adults unless something happens.

We all need to remember this is a small area, and these kids may not have told any adults at all, only their friends, who most likely told more people and so on. Word gets around pretty quickly about anything and everything that people don't want others to know about.

From what i have been led to believe the mother of the younger teen found some emails in which the two teens were corresponding and it was mentioned that they were having sex. The mom then took the emails to the dad (they are divorced and the dad is an attorney) and he pressed the charges. The younger teen confessed to four different sexual encounters which caused four felony counts to be charged against the older teen. Since the first comment was posted the older teen has been to court and has been convicted of one felony and is serving 18 months probation. He was also ordered to pay restitution to the younger teens family for all psychological counseling expenses.
The law states that the older teen is to stay away from the younger. If the older teen does not stay away he/she can be brought up on further charges. However, the law does not in any way protect the older teen from the younger teen continuing to pursue a relationship. The law clearly needs to be amended in that it gives protection to the older teen in the case of a fatal attraction type situation. The younger teen can continue to call, email, text, send messages through a third party, and anything else yet they are not in violation. If the older teen accepts the calls, emails, texts, or third party contact he/she is in violation and goes back to juvy and awaits further charges. This whole situation stinks. I know the law is meant to protect innocent victims and I hope that in some cases it does. Unfortuantly cases like this one the "victim" is causing continued trouble for the "felon".

couldnt agree more but that is not happening in our society. If one teen is going to be in violation of a law than both teens should be in violation of a law. We obviously have a set of parents that are embarrased that their teen is having sex or they just don't want to deal with their own obvious problem that they are using the law to punish another child. They are projecting their problem on someone else. Do they honestly think their child, the younger teen, is going to stop at one sexual encounter. HA HA

You may want to google or search out the "Romeo & Juliet" clause to Kansas Law. I believe that takes the Statutary Rape out of play when the ages are that close... I don't think they are going to have much luck getting a Conviction on this on....

OH you are very wrong about this. The laws do pick on the older of the two. I personally think this law is stupid. Kids are going to be kids. I know of an incident in Wilson County, where the boy was branded a sex offender and the girl in question continued to call his parents house even after the fact. Then she moved onto an 18yr old boy. So personally I think she should have been punished too. THere is a big difference between someone actually being forced and kids that are just experimenting.

Isnt there enough for our law enforcement officers to spend there time on than this!

Parents need to teach there kids SAFE SEX or abstinence.

we do have sex ED classes to teach our kids but also the parents need to teach it also yet the kids see lots of sex on tv so they are going to try it.but the parents need to set some guidelines and say this is wrong but we cant be with our kids 24hrs a day

Yes, I agree with how it once was. But, with this new Romeo & Juliet law, things have changed a great deal. I have seen it happen many times and think a crime has been committed, but then remember the Romeo & Juliet Law and have to go on about my business.....

If one get's charged I think some how they both should no matter what. If its not rape then there both consenting of what is illegal and the girl is no more in the right then the guy. I'm not going to judge either side but what I will judge is the fact that also is it a crime to have sex with a minor BUT its also a fact it is illegal for a minor EVEN TO HAVE SEX. So what's good for one IS good for the other or just let it ride and let them both destroy there own lives. What tick's me off of all that is the courts dont catch onto that fact that it is in the law books about minors even having sex that in the end of all that the guy normally gets arrested and thats all while the girl get's nothing but MAYBE her parents scorn for a while then goes out looking for another guy just of age to do it with again and no offence but allot of them even lie about there age just to get what they want, And no one does anything about that so what is good for one IS good for the other in my vote.
