The council approved a five-year $32,000 incentive plan for The Happy Clam, which will be at 1017 Sophia St. The site was formerly the home of B&G Seafood, which operated for more than 50 years.
The Happy Clam operated in Colonial Beach for 25 years but was destroyed by Hurricane Isabel in 2003.

What effect did the bankrupcy have on the judgement? No one in their right mind would start a business if there were enforcable judgements against the new business at the start! I would think that if the landloard had a claim against the old business he would be paid from the liquidation and write the remaining loss off his taxes.

I say let by-gones be by-gones and focus on the future. I read the owners of the Lighthouse are adding on an 8,000 square foot outdoor dining area. All seems fine. Let's hope for a bright spring filled with positive comments on Topix vs. having so much acid tossed about. It doesn't serve any purpose.

When it was next to the Baptist Church (the old Landing).
OK... I guess the difference in proprietors from next to Wilkersonís to the ones who ran it next to the church is what caused the difference in quality, eh? Not sure cause I havenít eaten at the one next to the church. Thanks for the feed back Bill.

Agree by-Gones. just let it go. What good comes from bringing it up over and over?
Clam and Tides have moved forward and are each doing there own thing. Good luck to both.

How do you get City tax incentives when you just claimed bankruptcy?? How about paying back your debts to the hardworking people you stiffed.
Are you sure it is the same owners? Was the Moncures the owners of the Happy Clam when it was next to the Church? Or was it someone else? I thought the Moncures had sold it to someone else... now it's gone and there is the Light House. The clam opening up in Fredericksburg is being started by the original owners before Isabel struck. Yes?, No?

So if they were not the owners when the Clam had a judgement against it why would they be held responsible for the other owners debt? Just Asking, and don't think it sounds right.

...and unless the naysayers are willing to drive to Fredericksburg for crabcakes, then it is all a mute point.

They were the owners, and rented??? the building from the Blunts. Most people know they had a big problem paying their rent.

Richard Moncure owns Colonial Beach Seafood. The Happy Clam name operates under this umbrella. It did so when they were located near wilkersons and also when they were located at the old Landing where the light house restaurant is today. The name and business were never sold. The judgement referenced above about money owed for back rent is to the Blunt brothers who own the light house. The true amount,if any that is truly owed all depends on who you talk to. Personally If you let someone get $60,000 into you for monthly rent then you did not do your part to stop the bleeding before it ever got near that amount.

Read the judgement, it is for missing equipment, destroying property, and months of rent free business...Virginia recognizes the "Tenant Landlord Act" not Landlord Tenant Act.. try to throw a tenant out these days.. dont know much about this case except for what I read on the judgement...
