And that my friends, is why a non-compete isn't worth the paper it is written on. It will cost many thousands to make the complaint and punitive damages are never awarded, no matter what the non-compete states.

I disagree. Viewed unfavorably by the courts perhaps, but often enforced, in my experience. And, punitive damages aside, hopefully Beaver got an attorneys' fees provision. If found in violation of the non-compete, Bolden might pay damages, Bolden's lawyers, and Beaver's lawyers.

Why did this schmuck sell his business, sign this, and go back to work in the same industry? I hope he loses.

"The Cousins" are operating a business -- Bolden is teaching methods and providing supplies. How can he be competing?

The issue will be whether supplying contractors with training & equipment is competion. Since the company seems focused on the retail end. They're going to have an uphill battle.

Sounds like they are running a water restoration busines and in direct competition with the new business from reading this article. I disagree with the mere use of the name "Bolden's as being in violation of the non compete agreement. More power to both.

well all I know is that Bolden's Carpet Cleaning has done great work for us. The new owners are great. Plus the Beavers have done alot for our community, but people don't bring up the good things!! Sounds like Kurt Bolden is the one with the ethics we should be looking at. People tell me he thinks he can get what he wants with money. Plus isn't his daughter the one who got the coach at Hamilton Heights fired??? I think so..... lets talk about ethic now. Guess the court will decide! What goes around comes around!!!

A couple of the Beavers are in the slammer on a felony conviction for concrete price fixing, and aren't the Beavers & Boldens somewhat related via marriage???

It's getting pretty twisted now.

The Bolden's cousin's are in deed related to the Beaver's. But they are great guys as well as the two at Terre Haute. The are trying to make an honest business, a success by giving good service and good work ethics. Bolden has gone behind their backs to customers of theirs and have tried to get them to return to him thus cutting into their business. How much different is this than price fixing. Sounds illegal to me. After all he did sign not to move in their territory. He is trying to make his new business go by taking away their customers.

Well lets see The Beaver that is suing Bolden his sister was/is married to Bolden(they are in teh middle of Divorce) So lets see think Beaver is mad that Kurt is Divorcing his sister I think so Get over it Tim grow up and let your sister take care of her own battle. Suck it up all Kurt wants to do is make a living and do what he knows if he is trying to teach what the heck does that have to do with you....Just cause you are a Beaver or a Bolden doesn't mean you own Noblesville......So Tim is your sister going to reain a Bolden or a Beaver, Just remember you will always be related to a Bolden
