Search Dogs scratches vehicles finds nothing

My neighbor got pulled over and was asked if he had anything on him? No, he said he let them search him. Then was asked if there was anything in the car again nothing was found. Then a dog was bought out to search the vehicle the dog was allowed to jump on the car scratching it in two of three places. Nothing was found again. Why are these dogs allowed to scratch vehicles? Oh, and by the way my neighbor has no record or has been in trouble with the law.

No idea.
My hood was scratched years ago when I was in High School by a dog that they brought through the lot while everyone was inside and oblivious. I was told there was one on my car by the kids coming in from vocational school. I mentioned the scratches to the principal and he denied having dogs out there.
I don't know. They need to put mittens on them.
When they actually find something, the 'signal' is usually to calmly sit and look at their handler.

Thats why you always refuse a search. If they dont have probable cause then just say no. If you give them consent then they can pretty much rip your car a part without consequences. Just remember they cant hold you or search your vehicle without cause. All you have to say is Officer are you detaining me or am I free to go. If you havent done anything then legally they cant detain you for longer than a few minutes without making an arrest.

get an estimate take it to city hall ask for payment and tell them what happened , also have a hand written statement what happened and turn in with your estimate keep a copy of both for your records , if they refuse take the city to court ! Until WE stand up for our rights they will abuse them!

Maybe, but maybe not. They cant hold you longer than a certain amount of time even for the dog. Not unless they are detaining with for probable cause.Otherwise they have to make an arrest. If they have a dog 5 minutes away and the officer smells weed then maybe. But still ask if you are being detained or if you are allowed to go. Trust me. As a black male just about anytime Im pulled over for anything Ive been asked for a search. I used to let them all the time because I dont do anything illegal. Then I found out I can refuse and Ive never been searched since. Even if you have nothing on you refuse the search anyways. Im sure most officers are on the up and up, but you may get a crooked one that may plant something in your trunk, or maybe one of your dumb ass friends dropped a roach in the back months ago. Dont take the chance. Know your rights. If they search you anyways, of course comply. But it could get thrown out in court if you didnt give them permission.

Actually, you Do have the right to refuse a search, with or without a dog present. If you are not under arrest you are NOT required under Ky Law to wait for a K-9 unit to arrive on scene. Your refusal is grounds for dismissal should you wind up arrested and in court. At the very least you can ask the Officer if you are being detained, and if so what charges does he/she anticipate? If they have nothing to hold you on then you are free to leave at anytime. A speeding ticket is NOT probable cause to search a vehicle unless there is something illegal in plain sight; or the officer has reason to believe he/she will find evidence of wrongdoing in a search (i.e strong odor of marijuana coming from the car). By consenting you are also giving the police the right to search AND seize and anything they find can be used as evidence against you in court.

Ahah Thats exactly what I said. But according to this guy the laws changed. So let his dumb ass sit there and get searched and seized, while well informed citizens like you and I continue to protect our rights. IF the law actually had changed then it would have been all over the news as a bigger story than gun control.

just a word of advice- at night, make sure your little light around the license plate is working. Period. That is all the reason ANY Officer needs to pull you over-whether you think you violated any law or not. SO- keep that little light working or step (1) for law enforcement just got easier. If they give you a warning...good for you. The fine is minimal...costs two seconds. The daytime excuse to see what your up to is the 'seatbelt'...so buckle...for real.

Unless I am arrested or they have a search warrant, I never allow a search. PERIOD. I have never been arrested. Nor have I ever seen a search warrant. And no, I have never had my vehicle searched.

People, know your rights to refusal. I will play this game with them anytime. As I so not have anything illegal in my car, my home or on my person.

A light out on your car, speeding, no turn sigal or other equipment or moving violation is not probable cause to search. It DOES give them a reason to pull you over. At that point they may see something in plain sight that creates probable cause.

However, do remember, they do not need a reason to pull you over, as driving is a PRIVILEGE in KY, not a right. Besides, they can "create" a reason that you nor they can prove exists. "Weaving" is one that is frequently used.

They like to have a reason to pull you over, as then you cannot claim harassment.

Um, all dogs go into heat twice a year for about the same amount of time. That is the only time they can get pregnant. Wish humans were the same way.

True on that weaving thing. I was going downtown about midnight, no other cars on the road, but I did have a dvd player playing, so it was bright inside my truck. An officer was running a speed trap by harrods or that green house near the bottom of the hill, and pulled me over. Claims I was weaving. I wasnt. I hadnt had a drop of liquor. He sees Im straight and allows me on my way.
