Back child support leads to prison

A Florida man who said he did not pay more than $200,000 in child support because he doesn't live in Indiana and because of his religious beliefs has been sentenced to two years in prison.

I have back child support in the amount of $18,000.00 and now the county has a felony warrant for my arrest. Last year I went through the same situation and got a felony warrant so now I have 2 felonies due to failure to pay child support. I am currently still on probation from the first failure to pay, But 6 months ago I got diagnosed with epilepsy and my doctor took me of work until he can find the right medicine that will work with me, Because I have at least 2 seizures a week and got fired from work because of it. The county has all of my documents stating what the doctor wrote and the do not give a damn. How can you be on disability and not able to work at the time and still get prosecuted for it? I have a total of 4 felonies in my lifetime and now that makes me a 4th habitual offender also my probation officer had to give me a probation violation because I caught another felony (Failure to pay child support)while still on probation. Now my officer tells me that I am looking at 6 years because of these crimes. And also I almost forgot to say that I have to pay $550 a month for one child and the tell me that they cannot lower my child support anymore. How can I support my family, pay bills, rent, food, etc. This just don't make sense to me everything that I have been trying positive it turns and bites me in the behind. If anyone has an information or knows someone that has been in a similar situation email me please and let me know how it went. actually according to indiana child support guidelines they base the amount of child support on a % of what you make.
(ex. 55% for 1 child, 60% for 2 children ect......)

My husband has a 6 year old son. He was never married to the Mom , Etc. He took the child home form the hospital, and had him for the 1st 2 yrs of his life. When he was 2 1/2; my husband & I started dating. We became serious... He let the mother see the child more frequently!! We married when the child was 3; I invited the Mother to the wedding; inwhich she came. We had a son together when child was 3 months shy of his 4th B-day! From then on Mother has tried to keep father away from son. She has played these little games for over two years. I think it's becasue she wanted what she couldn't have.(my husband). We have filed for visitation & support for child in June 2007. We haven't had the means to go to court, thats why it has taken so long. She has NEVER filed for Child Support, but now that we want visitation, and Custody if we can; she is wanting back child support since birth!!! This I think is NOT right... We have tried everything to see this child that we lOVE so very much. She just grabs the phone from childs ear, and hangs up! She will NOT answer any of the familys calls.. He is just as much my husbands child as he is mine. We cry everyday, because we MISS him soooo VERY much! She lives in IN with child & we live in KY. Can she get back child support from us?? What should we do? Why is she doing this?

How did she regain physical custody of the child? Can he prove he raised the child up until she regained physical custody? Yes Indiana can back support to birth but if he has done as you say and raised the child from birth than he will need to prove that. She is entitled to support if she has the child but he is also entitled to visitation. There are alot of self help sites on this and you can file without an attorney. Something in your story seems a little strange but I shall await your response to see if maybe I miss read something.

The truth would've gotten him some lea way; and alittle knowledge of the law as well. Use faith as a reason to have made no effort for so long; nice!
He'll get out in about 6 months, on probation.

I know of a guy that is more than 60,000 in arrears he is a truck drive, Indiana has done nothing. Another guy the mother has constantly provided work addresses, home addresses and Indiana has done nothing. Indiana is not for the children or the custodial parent UNLESS they are on public assistance than they are more than willing to cross the country per-se to nab the tax return in which the State keeps and the child(ren) see nothing.

I would like to add to this. Lets say that if the child/children resides in the same home as the non-custodial Parent, would NCP have to pay that much? A: NO
If the NCP could file C-support on their taxes, the prisons will be occupied with criminals only. Finally, If the system would apply the harsh laws only to those whom run from their responsiblities, and allow NCP their rights, America would be a better place.

I agree that parents should have to pay for their children..It's their responsible..They made them. The law should also not be gender bias, but they are and we as the people should standup and have the laws changed. These states child support agencies are collecting monies and are really not keeping up with the records as required, meaning if you just keep paying and not inquire as to the balance, they won't tell you

Carl, I agree with your post 100%. Lock the women up to and throw away the key. But if there in prison just like a man, then they won't be able to pay child support. The law is wrong on locking any person up for child support. That is nonsense.

Unfortunately there are lots of mothers who don't pay support as ordered by the court. They, too, should see the inside of a jail when they've not paid for a period of time, just like dads who don't pay. And the kids who are stuck between mom, dad, the court; some where along the line, someone forgot the kids. And they are who this is supposed to be all about!

The line about "we became serious and my husband started letting mom see the child". Translated, that means, man and woman seeing so much of each other they had no time for this little kid that he'd taken care of since birth. So, he lets the mom see the kid more and more and more, until one day he wakes up and realizes the kid isn't with him anymore, but with the mom. I wouldn't try and figure this one out without an attorney for both sides. They are going to need one!

Should have taken care of things as they came along, stopped accumulating felonies. First things first. Now you are in a muddle and will have to fish yourself out. My old friend said its no sin to fall in a mud hole, but it is a sin to just sit there and feel sorry for yourself.

I am also fighting with my Ex over back child support. I served in the U.S. Army when I divorced him, and he payed me less than $1,000. and is now over 13,000 in the rears. Get this and now because of all of this taking so long we have a Grandchild of our youngest child. How do Father's get away with NOT paying Child Support? I did not make these children on my own, I was nice during the divorce, he got to see them whenever he wanted and he is still being a PUTZ!

I work in the legal system and know for a fact that women do spend time in jail for back support.

I wish Indiana were more stringent on going after the non-custodial parents. My child's father was ordered a whole 45.00 a week in 1989 he has paid a whole 545.00 in that time period. I have always known where he was and working and have always notified Tippecanoe County by way of modification and contempt on his part, to this day his license are in tact, he gets his tax refunds, and I was told if I had went on welfare before my daughter turned 18 the State would have been better prepared to help. What kind of crap is that. Now they are telling me I have 20 yrs from the date she turned 21 to collect. When I asked how am I suppose to do that they told me to hire another attorney.
