Fatal crash survivors lose patience with Cape Coral cops

I’m a tad confused here, it would seem neither car slowed or stopped at a yellow light and the car struck by the truck didn’t yield for right of way traffic. It would seem as though the car driving east on Veterans would have the right of way and the car turning onto CC turned illegally actually causing the accident. I could be wrong but it looks like some serious finger pointing here and perhaps if Ernesto were wearing a seat belt he may be alive today. Gee with all those responsible people in one car none was responsible enough to be more responsible so I suppose the next best thing to do would be blame someone else. Wow how typical!! Well I’d say the driver of the car that got hit was the responsible party here but sure let’s blame alcohol. Pull out in front of a car, get hit and hope to hell after YOU cause a fatal crash the OTHER person was drinking. Makes you feel a little better about killing someone I guess.

Well the girl driver caused the crash, if you can't figure that out from reading the story that isn't my problem. Education sucks doesn't it?

Indeed someone is always to blame. If im not mistaken this intersction does have cameras. Why this evuidence hasnt been brought forward you can ask "big brother" about...

Non the less the driver of the car at fault was drunk. Its hard to get a straight story from reading it i thought but the picture is painted pretty clear the drive at fault was drunk and hasnt been charged as of yet. Granted it happend here in cape coral but the real people they should want to talk to would be the State attorney or perhaps the FHP they deal with all traffic homicides. Perhaps im wrong.

I can see why this lady is so distraught and is wanting someone to blame. This was no ordinary accident. There was a felony commited durning this accident " driving drunk" and to lose a loved one must hurt. But i say blame ccpd too they are a bunch of clowns. I hope this family finally gets some justice they've been waiting for!

She’s wanting someone to blame because she cut into the path of another car, she is ultimately responsible for the death of her passenger. Just look at what she keeps repeating about how she continues to relive it and how it haunts her. She’s hoping if they charge him it will lift the guilt from her but it won’t because she knows deep down she made a split second decision that killed a person. She’s guilt ridden. It doesn’t matter if they charge the other driver or not it will never change what really happened.

Yep..he got 13 years for that dumb girls crappy driving. Oh well. There's a dead person and he can spend life in prison but SHE is ultimately responsible for his death. She murdered him.

I agree with YNG. Regardless if the other driver had been drinking or not, SHE pulled into the path of an oncoming car. SHE caused the accident and got off on a technicality. SHE is to blame. The inebriated driver is guilty of driving while intoxicated.

it seems too me that you guys havent fully read the report he claims to have hit the brakes because the light has turned yellow and that you could see the skidd marks then he crashed into her which by the way in the police report there were no skid marks located were he claimed it to be... then in court he claimed he doesnt remeber anything that happened that night

You are absolutely correct. The other driver can only be charged with DUI. Now if he was DUI and caused the accident then he would have been charged with DUI manslaughter.
