The driving force behind all of the board, attorney and management problems is the unit/home owners themselves. Apathy stands in the way of developing a corporation that functions for the benefit of the members. Understand that while common interest realty associations in Florida sprang from CH 617 F.S. and subsequently established in CH 718, 720, 721, they do not have "shareholders". This is the fundamental problem with the structure. Read CH 617 and you will see that the not-for-profit corporate act presumes that all corporations operating out of this structure have "shareholders". Homeowner and Condominium associations have no shareholders. I have written a book explaining the structure and the current deficiencies in operations which have caused, and continue to cause, the extant problems; and we address the solutions to establishing proper corporations for governing these types of common interest communities. Correcting the structure is preferable to begging the Legislature to address a couple of problems per year. Picking at this sore will not cause it to heal. STAY AWAY FROM EDGEWATER CONDO'S IN CORAL SPRINGS. THERE ARE GANGS OF KIDS THAT WALK AROUND AT NIGHT AND VANDALIZE CARS and FOUR PEOPLE HAVE BEEN MUGGED IN THE LAST 6 months WALKING TO AND FROM THEIR CAR !

I agree with you. Iwould like to do the same. But how do you stop paying HOA feesand the mortgageand just walk away. Aren't you still responsible for the mortgage?

You agreed to abide by the HOA documents and signed an agreement to that effect. That's a legal and binding contract, as is your mortgage.
If you walk away from either or both, the offended party(s) can, and I'm sure will, sue you. You would then be liable not only for the missed payments, but also late fees, penalties and ALL legal fees.
As a parting gesture, your credit worthiness will be zilch and your home liened, then sold at foreclosure.

I'm on the board along with others yet only the president is the only one that is listed with our accountants. I contacted them to get the names and address's of owners and was refused stating you have to get it from your president. Now she won't even give them to me. What can I do?

In Omaha NE, Twin Towers Condo Assoc. is running a deficit of $80,000. Bd President claimed she wasn't aware of office manager not paying a lot of the recurring bills. At least we got that unqualified employee fired.

Because, most likely, you'll use that information to your own advantage and possibly embariss someone! The pres is smart! Unless you have priviously worked with the accountant, the pres makes the call.
Don't try to go over the Prez's head! Imagine the position you put the board in if it got out you had that info?
If you are on the board, get involved more, Then you wouldn't have to call to find out...you would already know!
