Judge to reconsider plea in '07 toddler murder

The Flora Vista man sentenced to life in prison after pleading in November to a toddler's stomping death will return to district court today requesting the original plea deal be withdrawn.

Are you kidding? This man stomped a baby that did not know why but knew it hurt. He got less punishment then he should have. Let it go to trial and see what the public would give him.

He needs to be stomped and put through what Taegan was he is a pathetic excuse for a human. I know the McKinneys and their lives are forever changed they lost thier precious baby girl because of some drugged IDIOT!!! He didnt even deserve a trial shouldve went straight to the chair!

Why would Judge Price, agree to hear
this man's original plea deal withdrawl, taking up court time and
costing the taxpayer a bunch.

Crazy what drugs can do to a family! Keep in mind for the family on his side what they must be going through and to wonder were they went wrong and at the same time to love this child becouse he is still your son, Grandson, or brother. It is one thing to be angry or have an opinion but to be that hateful makes us no better after all even they (McKinneys) did not see the monster they allowed him in there home and around there children, does that make them guilty too.... No some times bad things happen to inocent people all we can do is pray and watch our own children and do the best we can as parents.

Jose Garcia knew what he was doing when he murdered that little girl, and he knew what he was agreeing to when he took the plea. Now that things have settled down he wants to try and say he didn't understand? He is just trying to find an easy way out so he doesn't have to do his time, and I think he needs stay right where he is at.

They didn't allow this monster into their home!! They allowed a babysitter whom they trusted with there child into their home and she allowed this monster in. He deserves to be where he is at. Teagan was completely helpless, and had to go thru that, she had to die so someone could have fun for awhile. His parents should have taught him better also.

I agree with Garcia with the fact that he shouldn't be given life in prison. He should face death for the horrific act he commited. This is a prime example of a justice system that fails the victim and her family. Just when you think the healing process can begin, now this??

By all means withdraw his plea. Then try him on murder one. By the books, I think this would qualify because he caused the death of another person while in commission of a felony. The felony? Holding the baby-sitter by her throat so that she could not breathe. That constitutes an act of assault which would justifiably cause a person to believe they could die (felony). Taegen was killed during this mayhem. Murder one. Capital Offense.
On the other hand, Taegen's family has gone through the worst imaginable ordeal. Don't they deserve to be allowed some peace? I can not believe that our courts would allow this type of torture to continue. If there were one, decent bone in Jose's body, he would serve his sentence quietly. Hopefully with remorse.

On the other hand EVERYONE, your right, but hey I'm a morbid person and would love to get this guy alone for a heartbeat, but you all,save one or two,are totaly right on the mark. IF they let this guy pull his plea, then we can get him in court, and deliver a sentence that will rock the USA! A very unkind one!

I agree. Justice has been done, some want more, the criminal wants less. But it's over. Let the verdict stand.

My gut feeling is that the killer found out how horrible prison is and wants any road out.

Wait, I figured it out. He hooked up with a jailhouse lawyer that informed him he's screwed if he doesn't take back his plea because he can't appeal multiple times and try for a pardon.

Guilty Rat Vermin that he is.

From sources close to her family, I heard that she had a breakdown and was hospitalized. There has been a lot of talk about this girl... from what I remember of her, she was a pretty good kid. She just got involved in a relationship with a drug-addicted, violent creep. Still not excuseable, but what 15 year old girl knows how to deal with that kind of guy?
