Cocaine charges against Fitchburg man dropped

WORCESTER -- Charges have been dropped against a central figure in a two-year drug investigation that resulted in the firing of a veteran Fitchburg police officer, after a key witness in the case twice failed to appear in court.
Lazaro Paulino, 37, of 39 Winter St., Fitchburg, was indicted on two counts of trafficking between 28 and 100 grams of cocaine in January 2012 as a result of Operation Red Wolf, a two-year multiagency investigation into gang activity and drug trafficking in Fitchburg that indicted about 20 other local men on various charges, according to the office of Worcester District Attorney Joseph D. Early Jr.
Paulino had pleaded not guilty to his charges on Jan. 26, 2012, in Worcester Superior Court and was released on $10,000 cash bail.
The same day, Fitchburg police Lt. Joaquin Kilson was placed on administrative leave following the FBI's discovery that he had maintained a close relationship with Paulino. Kilson was later fired from the department in May 2012.
Paulino went on trial twice in September, and both times the key witness did not show up to testify, according to Early spokesman Tim Connolly.
"The key witness was notified of his duty, and he was summoned properly both times," Connolly said. "Neither time did he show."
He said the first trial date was Sept. 9, and when the witness failed to appear, Assistant District Attorney Sarah Richardson moved to continue the case to Sept. 30, and Judge Richard Tucker agreed.
On Monday, when the witness again failed to appear, the defense moved to drop the charges and Judge James Lemire agreed to dismiss the charges without prejudice, Connolly said.
It is unclear what bearing, if any, the dismissal may have on Kilson, who has fought unsuccessfully to get his job back since his discharge.
Kilson, once an often-lauded drug detective and a 19-year veteran of the department, was found to have maintained regular social and telephone contact with Paulino, as well as stayed in his home in the Dominican Republic, according to investigators.
An internal investigation report alleged that Kilson's answers were inconsistent while under questioning by federal, state and local investigators. It also alleged that Kilson purposefully compromised an investigation by tipping off dealers to a planned raid, jeopardizing the safety of all of the officers involved, and that he allegedly attempted to set up a meeting between two drug dealers so one could confront the other about the poor quality of the cocaine one was selling.
Detective Keith Bourne, president of the Fitchburg police union, maintains that Kilson and Paulino became friends over their common Dominican heritage and that Kilson was not aware of Paulino's alleged dealings.
"This recent decision by the courts to dismiss the charges (against Paulino) I believe will only help our case to prove that the city's charges to dismiss (Kilson) were unfounded," Bourne said Thursday.
"They had witnesses who were unwilling to come forward for whatever reason," he added. "Maybe they weren't very strong witnesses."
To this day, Bourne said, Kilson has never had a chance to prove his case, in front of an arbitrator or through civil service, nor has he had the chance to face his accusers.
He said the union was led to believe the city would waive civil service and the case would go to arbitration, but it was later discovered that a clause in Kilson's contract prohibited it. At that point, the deadline to appeal to civil service had long passed, Bourne said. They have petitioned to have the case be heard past the deadline and are waiting to hear a decision from the civil service commissioner.

Just imagine if I was employed by the FBI, I could get many people caught for corruption.

I like both the Mayor and the Chief but I have attempted to explain to both to run things correctly. There is an ongoing federal probe of the workings of the FPD and of the city of Fitchburg. There are questions of police involvement concerning the gangs inside of Fitchburg.
The investigation consists of unsolved murders, gun running and drug dealing. There is a serious rogue situation concerning the FPD. This probe will reach into the courts as well. We need to follow the money trail.
It is time to clean the city out and I was more than willing to assist the Federal law enforcement when I was brought in and recruited!"
