Jeremiah's father in custody hearing

FITCHBURG -- Jose Oliver, father of missing 5-year-old Jeremiah Oliver, spent only a few minutes in a custody hearing Friday at Fitchburg District Court before emerging from the courtroom.
He vowed to continue to fight for custody of his two other children with Elsa Oliver, but declined to speak about the results of the brief hearing. He said another hearing was scheduled, but he did not say when it would be held.
"I'm ready for whatever it takes to get my kids back.... Nobody's gonna love my kids the way I love them because they're my kids," Jose Oliver said.
The children, a 7-year-old girl and a 9-year-old boy, have been in custody of the state Department of Children and Families since their mother and her boyfriend, Alberto Sierra Jr.
were arrested last month and charged in connection with the disappearance of Jeremiah, who has been missing since September. Elsa Oliver remains under mental-health evaluation to determine her competency, while Sierra, deemed dangerous by the court, is being held without bail.
Jose Oliver, who was arrested Dec. 30 in his hometown of New Britain, Conn., on charges he sold 30 bags of heroin to an undercover officer in a police sting near an elementary school, declined to speak directly about the charges he is facing, but appeared to express regret.
"I was a desperate father, so much confusion in my head, so much emotion," he said. "I did a mistake and I'm human. Don't judge me. Don't judge me for my mistakes. I'm only human."
Oliver asked for the focus to be taken off him and put back on finding Jeremiah. He said it becomes more painful and frustrating each day that passes without his son being found.
"The most important thing is to find my son and where he's at," he said. "Everything else doesn't matter."
His brother, Sandrino Oliver, agreed.
"There's still a black hole in my heart, not knowing where he's at," he said.
The brothers asked that if anyone has Jeremiah to please release him to the authorities, and promised no charges would be placed against them. Jose Oliver thanked those who have stood by him and continue to search for Jeremiah.
"We are never going to stop," Sandrino Oliver said. "This ain't going to stop until we find him. If it takes two, three years, whatever, we'll continue. We'll continue searching for my nephew."

Another search is planned for today at 10 a.m. Searchers will again meet across the street from Elsa Oliver's home at 276 Kimball St.
Search organizer Miguel Fleitas said this weekend's search would focus on four different areas within a 5-mile radius of the house, but he declined to give exact locations, citing law enforcement concerns that advertising the locations could potentially lead to evidence being destroyed.
He said the search will include a K-9 search-and-rescue team, off-duty officers from area towns, military veterans and Boston-based private investigator Tom Shamshak, who previously served as police chief of the towns of Spencer and Winthrop.
"I just want to find any evidence that can lead law enforcement to finding Jeremiah," Fleitas said. "We're praying that he's alive."
He warned potential participants to wear proper footwear and clothing for the search, which is expected to last as long as three hours, because the ground is still covered with snow and ice.
Meanwhile, the House's oversight panel plans to hold a hearing Jan. 23 on DCF. Chaired by Rep. David Linsky, the House Post Audit and Oversight Committee will hold the hearing with House members of the Children, Families and Persons with Disabilities Committee.
The panel has invited DCF Commissioner Olga Roche, Child Advocate Gail Garinger and representatives from SEIU Local 509, the union that represents DCF caseworkers, to testify in Gardner Auditorium for the 11 a.m. hearing.
Elsa Oliver's competency hearing had been scheduled for Friday but was postponed to Jan. 23. Both she and Sierra are also due back in court Jan. 24.
