Man charged with rape of Westminster woman

WESTMINSTER -- A Gloucester man is awaiting arraignment in Gardner District Court on charges that he raped, tortured and kidnapped a Westminster woman in her home last month.

John W. Wagner, 42, of 16 Pear St., Gloucester, is being held at Middlesex County Jail in Cambridge on charges related to the incident that is alleged to have happened on June 27.

A woman told state police investigators that she met Wagner on a dating website two months ago and had been in a romantic relationship for six weeks. About two weeks into the relationship, she said he changed and became verbally abusive, aggressive and was physical at one point.

According to the report, the woman told state police:

On June 26, after her son's birthday party, Wagner used loud profanities during an argument over the telephone and became infuriated when his girlfriend asked him to stop.

The report continues: After the phone call, at about 11:30 p.m., he grabbed her hair and dragged her into the bedroom and made several death threats. He then proceeded to choke her and smash her head against the bed. He periodically took cigarette breaks on the porch, pulling her with him, and then returning and continuing the assault. He also held a series of kitchen knives to her throat.

He then proceeded to rape her. The woman said the more she protested, the more aggressive he became. The entire incident went on for some time, and he eventually fell asleep. She said this went on until the next day at 7 a.m.
She attempted to call a friend on her cellphone, but Wagner woke up and allegedly spoke into the phone, saying this is not a good time, hung up and smashed the phone. He then ransacked the bedroom looking for valuables and ripped a Pandora bracelet off her wrist with his teeth.

He then forced her to pack all of his belongings into her car and made her drive to her bank in Leominster, and said he would kill her and her son if she didn't give him all of the money in her account. She withdrew most of her money, but begged him to let her keep $60 for her son's birthday cake.

He forced her to continue driving, and a motorist reportedly observed him strike her in the car while they were eastbound on Route 2 in Acton. The police report does not reveal where they were headed, but she pulled the car over in the employee parking lot at Massachusetts Correctional Institution in Concord, where Wagner was arrested.

While police approached the vehicle, Wagner allegedly threatened to kill the woman if she said anything. She was transported to Emerson Hospital in Concord for injuries she sustained during the alleged assault.

Wagner faces charges in two different counties for the incident, according to state police, because Acton and Concord are in Middlesex County.

He is scheduled to be arraigned Aug. 1 in Gardner District Court on three counts of aggravated rape and one count of kidnapping. He has filed paperwork requesting a speedy trial.

Wagner was arraigned June 28 in Concord District Court related to allegedly striking the victim in her automobile while driving in Acton, according to Stephanie Chelf Guyotte, a spokeswoman for Middlesex District Attorney Gerard Leone.

Wagner is charged with domestic assault and battery and intimidating a witness is Middlesex County. His next appearance at Concord District Court is scheduled for July 30.
