It has ZERO to do with what it looks like & everything to do with overhead clearances for power lines, cranes, boom trucks, telephone lines, etc.

If the city grants a major variance to him then the Genie is out of the bottle; won't it back in & now everyone is permitted violations like this.

I do, however, understand his problem with nobody mentioning setbacks. Given that the deck goes all the way to the street, you'd think the roof being in full coverage would have been part of the discussion somewhere along the way.

Legal or right. It may not be legal to build where he did but should he expect the city code department to warn him when he submitted the drawings and paid for the permit? What city services did his permit fee pay? He is right. The city failed to perform. He should be allowed to poll his neighbors and if agreed by all be given the variance.

Why did the City wait until it was finished. When someone submits plans it is supposed to trigger inspections. I hope Mr. Hill prevails in this. Shame on the City for missing it if it is in fact violating code.

He should move to Gainesville. The city will let you build anything anywhere - ignore setbacks - as long as you apply for an allowance. Even if you've already built it. I wonder why Gainesville even has rules.

This is what you can expect when the US Citizen has no property rights anymore. They city takes his money for the permit, approve the permit, and then tell him he can't have the structure they permitted him to build? WTF is wrong with these idiots?

We hire the most incompotent people to run our city governments. Here in Little Rock, we have actually quit locking up criminals, because the jail is too full.

Nevermind the city can pay for evangelical religious services, like City Fest, but we don't have the money to keep the thugs from breaking into our homes.
