Challenge the county

BCSS is the problem. Read the STATE law. Read the County law. Find a good lawyer not associtated with the county. If you have a septic system you can challenge the county. The statement that you have to replace the septic system if it "fails" should be challenged. If your car brakes fail do you buy a new car or fix the brakes. Go to court with the county as a group. They have lost on forced sewage hook up before. JUST SAY NO! The cities of Fairhope and Daphne spill raw sewage into the Bay and pollute more than septic systems ever could. Call ADEM and check out the spills.

The laws that WERE in the planning and zoning manual for requiring an individual to hook up to sewage had three main points:
The hook up had to be reasonable, available and border your property.
In many cases the county or cities were telling people they had to hook up to these sewer systems even though they did not meet these three main requirements.ie.
$10,000 is not reasonable for someone who makes $35-$40K a year.
In many cases the lines did not border the property at all.
The county got sued and they pulled the REGS.
Now they have companies that run lines and think they can make you hook up to it.
Since when does a public utility MAKE you use their service.
If you have a septic system you MUST challenge their ambiguous definition of failure. Failure is by design not because a part breaks or is antiquated. YOU CAN REPLACE IT!!
Remember, even though these people are using right-of-ways that belong to the county they are not answering to the public service commission and they should.
If they decide to go out of business you are left with a sewage system that doesn't work and nobody is required to pick it up.
The laws regulating these sewage companies need to be completely revamped and all sewage companies need to fall under public service commission instead of letting rogue enterprise dictate to and abuse the public.

Has anyone looked into hiring a lawyer (CLASS ACTION). This seems to be a violation of antitrust laws, since this is the "public utility" for your area and you have no other option. You guys are getting raped!

Well get used to it you jerk. That is the beauty of Forums and Blogs. People can express their feelings which are valid to them and which they might be reluctant to express if they were known. The important thing on Forums and Blogs are peoples' opininons, points of view, replies to posts, etc. Who it is that posts them is not important. If you knew who I was, would it make any difference in what I have to say? Why do you want us to identify ourselves--are you an ambulance chaser who has some schlock lawyer on a retainer ready to sue us if you don't like what we say or are you just some noisy SOB who wants to know if it is your neighbor posting something that irritates you? By the way, could you please identify yourself by giving me your full name, address, social security number, phone number, current employer, credit card numbers, bank account numbers and anything else that you thing I might need to identify you just as you expect the rest of us to identify ourselves.
Sounds like you are the jerk. Only cowards hide behind anonymity. If you feel that strongly about your words, stand behind them and be the person willing to make a difference. Not the coward who throws rocks and hopes to be heard. Better yet, go down to BCSS and ask to see Clarence face to face. I promise you Clarence is not hiding from anyone.

So, I guess Salty Dog is your real name. I guess next, you will be posting as 'Sue'.

He won't come to his meetings where he is the developer of a subvivision, so what makes one think he will see someone else - he sends Daniel Craven, his attorney, to all his meetings. I've been to BCSS, and can't find the man. I've tried to find him at one of his development companies - and can hardly find an address and phone number for those - now who looks like they're hiding???

We have problems people. This sewer rate thing is just one more. Personally, I've put myself on the "vote out all incumbents" bandwagon. Federal, state, local, democrat, republican, whatever. I will vote against every incumbent running for office. Maybe, if enough people do this, the politicos will get the message that they are working for and are answerable to us, the voters! "We the People" need to take this country back...soon.

I'm all for that. If they can't enact term limits then let's do it for them. How else are we going to get rid of the good old boys who have been holding office since their ancestors got off of the Mayflower and still consider it their Devine Right to rule the rest of us?

The voters of Baldwin county should be aware of the connections of Tucker Dorsey, candidate for place 3 on the Baldwin County Commission, to Clarence Burke and Baldwin County Sewer System. Dorsey and Burke are business partners in one or more corporations run by Burke. You will remember that in 2008, the Baldwin County Commission voted to give East Central Baldwin Water control over sewer in it's service area. This was strongly opposed by Clarence Burke and BCSS. It appears that Mr. Burke is trying to get his man on county commission. Would this be like the fox guarding the hen house?

How could Cheney be responsible for the oil spill since he was in the Bush Administration? I thought all wars that spilled over into the Obama Presidency and the lack of government controls over the oil companies is the direct result of Obama. Let's face it, there is not one problem that we are faced with today that had anything to do with the Bush reign. All of our problems just came about during the last 17 months. If you don't believe me then just ask Fast Fred.

If I'm not mistaken, the requirement to have the acoustic shut-off valve was removed in the Cheney Energy Policy meetings. Did you know that the dispersents being used by BP were made by Halliburton - another Cheney connection? Also the piece of legislation making it the prime resposibility of the Oil Company, not the Federal Gov., to be in charge of the clean-up. Guess we've seen enough of that one though. What a hell of a mess, regardless of who caused it. It's a shame.

Is there now an alternative? BCSS is now (mid-2010)frantically trying to talk customers out of another sewer service. Who do I call to inquire about an alternative?

By the way, I called to complain back when this unbelievable increase was made. I guess I talked to the owner. Anyway, I pointed out that my sewer AND water bill in Mobile (primary residence) ran only $17/month. His reply: "I don't believe it." Does anyone think that he really did not know what other regional providers charge? I didn't think so!

Just found out some news about the Baldwin County Sewage. I was sent a letter asking me if I wanted a Grinder Pump extended warranty. I bought it and this week was told by the sewage company that the warranty was no good,I have my warranty papers and seeing a lawyer Thursday. Does this come under fraud or breach of contract??? As expensive as this sewage bill is,should be maintained by the company.$54.50 for a single resident household. We need some elected offials that are concerned and not just during election time. ELECT ALL NEW OFFIALS IN NOVEMBER.pS My grinder pump bill is $702.00

Does Baldwin County require everyone to hook up to the sewer service or do they allow you to have a septic tank if you so choose? With the water table so high I can see that a septic tank may not always work.

The only way to correct BCSS is all the people get together and demand changes. Vote out all the elected officials in office now and install new ones.Writing comments prove nothing. I hired a lawyer and so should other customers of BCSS,this is the only way to get the companies attention. We have to help each other. Our elected officials appear to do nothing.

baldqin county sewer systems has been rippi.g people off here for many years
my grandfather gave them an ease in the cr ten and cr sixty five area years ago. I have never seen a county where every home had to have a pump grinder. I know many people including myself who have had to replace multiple pump grinders in the last tqo years. the pump grinders cost over 18 hundred dollars with service call. its due to the fact we have pretty much anywhere the pipes are over 8 years old are about the.aize of an inch and 3/4. when our pumps went out they.blamed it on grease. we pour our grease out. It all falls back to the system at cr12 and cr65. they are just another monopoly, if anyone knows anything about making solar panels please contact me. I plan on being off the grid by this time next year then they can pay me. Not enough competition, to much corruption in this county that's why you see so many incomplete sub divisions.

*Tap Fee =$3500.00
*Grinder pump =$2276.00
*Install Fee =$585.00
*4 year warranty =$385.00
*Reconnect Fee (should something happen)=$400.00
Is it really necessary to add insult to injury by charging an additional $60.00 (minimum) a month for service? Really?! I hope this guy sleeps good at night, cuz hell is forever, and that's exactly where he'll spend eternity.
