This ruling demonstrates the failure of our DEMOCRAT LEGISLATORS who did not pass KARENS LAW in the last session. What a crime to let a killer get off in this manner.

here we go again, Hawaii Judicial System is a joke. Here they just put a guy away for 20 years for killing someone while driving DUI. Do the crime do the time in Virginia.

judge crandall is competing with judge karl sakamoto to see who can let the most murders out of jail to murder more people.

you can bet she would not have made that ruling if it were the family of another judge.

The comments on this blog show how blind the public is to the legal system. 1st, Prosecutor Carlisle let the Samoan guy who bludgeoned his girlfriend to death with a shotgun plead down to life with parole - under the 3 strikes law. 2nd, the judge in this case knows that this guy isn't getting away with murder - and Life with parole or life without for a 15 year old kid is a LOT of time for him to think - to assume that he will do only 15 years is a wrong assumption. Finally, we do not live in a medeival primitive society that endorses an eye for an eye mentality - OR DO WE?

Here we go again! Remember the guy who got off from the speeding violation on a technicality regarding the testing of the laser guns? The defense again outwits the prosecution. Seems like all the dumb-s are working for the State. Why didn't the prosecution know about this?

Come on give the guy a break, it was only his first time, he had never raped and murdered anybody before.

Judge Crandall took this into consideration and gave him the break he deserved.

Legislator Marcus Oshiro protected this kid when he did not support Karens Law. Representative Marcus Oshiro who has never been raped or murdered either, squashed the revised law as he thought the kid deserved a break too, after all it was only his first rape and murder, Marcus Oshiro realized that he was not a serial killer yet and should be given a break.

A good number of you seem to have missed the fact that he's still charged with murder.

"Technicality" is what people call a law that doesn't work in their favor.

Yes I know about this case and again the court system failed us. This case goes way back and the victim had no protection, no help of any kind from HPD, the legal system or anyone no matter how many times she asked for help.

Too bad they can't ask her how she feels about this now.

In a shocking turn of events, House Finance Chair Marcus Oshiro who didn’t even read the final draft of House Bill 819 killed Karen’s Law tonight without any warning to legislators.

HB 819 automatically tried juveniles that were charged with 1st Degree Murder as adults and sailed through the House and Senate with little opposition. HB 819 was supported by both Democrats and Republicans.

Finance Chair, Marcus Oshiro, missed FIVE conference committee hearings and was NOT present during crucial discussions about the bill between conferees.

"Karen's Law" would have applied to Vernon Bartley who allegedly raped and killed his neighbor Karen Ertell in 2007. The Ertell family and neighbors waited 15 months before Judge Francis Wong ruled that Bartley would be tried as an adult.

Put the blame fair & square on the sholders of Marcus Oshiro....boot him out at the next election.

No, this ruling demonstrates the failure of the District Attorney's office, AGAIN, to properly prepare for a case. The ADA presented no good rebuttal to the motion, so it was granted. Wait until the trial. The ADA will blow it. That's why these guys are not private attorneys. They wouldn't make it without a state job.

What law school did you attend? Look, the judge has to follow the law, she has no choice. The way the law was written, it left a big loophole that Jeffrey Hawk, who by the way is a heck of an attorney, drove through. The judge did not create the loophole, but she had to live with it. Now its up to the legislature to fix it.

I think we've all learned a very important lesson here. In the state of Hawaii a witness to a crime really ought to think twice about becoming involved. They will not be protected. If they step forward and end up raped and murdered (in their own home or on the beach) the perpetrator of the crime will most likely end up serving a insignificant period of time and being released while they are DEAD.

Hawaii's Justice System greatly favors criminals thanks to ACLU and the liberal judges who preside over such cases. When will the victims ever win?...
Remember folks judges in this state are appointed/approved by the Senate body of the Legislature....and the Square building on Beretania is filled with liberal Dumd-ocrats...
