whats the big deal on having your dna taken, they still take foot prints and hand and finger prints, on a newborn's birth certificate....why not just add a dna reference on the same certificate !,this will always be in the bureau of vital statics anyway !,in todays technology of the cyber world, and the improvements yet to come,be logical, and not so ignorant that the ones that should stray away from being an asset to socity and not a detrament, should have no rights anyway ! I would be willing to wager that the vast majority of complainers are not,registered votors ,pay no tax's, live off the govt's freebies,and/or carry felony records already....And then there's the simple way of collecting the dna from the ooozing blood coming from the hole in the head,between the eyes of the burglar,rapist of my family member......easy way or hard way it can still be done....."confucious "

Exactly Hommie...what is the difference between fingerprints and DNA other than technology? Quite frankly I would rather have my cheek swabbed than have to wash ink off my fingers LOL

I would rather you had a cheek swab too. That way I'd know if your daughter was suitable to marry. Fingerprints won't tell me that about you or your family.

The bill sailed through the New Mexico House of Representatives, 55-13. But the Senate, which became increasingly skeptical and critical of the proposal, approved a version with two significant changes.
One would delay swabbing for DNA until a court finds probable cause in felony arrests.
WHY ARE YOU PICKING THEM UP FOR PROBABLE CAUSE IN FELONY ARRESTS? FELONY ARREST ARE FELONY.
The other change would attach another section to Katie's Law that would make it easier to get an arrest record expunged.
EXPUNGED HOW THE CRIMINAL KNOWS SOMEONE IN THE COURTS?
The Legislature is supposed to look out for everybody's rights, including criminal suspects and the wrongly accused, said Sen. Michael Sanchez, D-Belen, one of the leaders to recast Katie's Law.
EVERYBODY'S RIGHTS, WHETHER CRIMINAL SUSPECT GOT THERE ON THERE WRONG DOING!!
Sen. Richard Martinez, D-Espanola, said adding a probable cause protection would prevent police from bringing "trumped-up" felony charges.
WHAT HAPPENED TO DOUBLE JEOPARDY HOW WOULD THEY "TRUMP UP?"
It also would preclude the state from collecting DNA in cases that were reduced from felonies to misdemeanors, he said.

Answer is simple. The person leading the charge on keeping this bill down Michael Sanchez is a lawyer. Go figure. Richard Martinez, Magistrate Judge (Ret). Look at his sentencing record. Very weak as judge. I think a law should be passed to prevent lawyers from being law makers. Conflict of interest. They see their clients getting harder to defend when evidence nails their coffins shut.

Not to be crass but if the Police can obtain DNA ..... Why can't they obtain samples in DWI arrests? There are a heck of a lot of deaths in New Mexico from Drunk Drivers! If somebody drives drunk... take their license, impound their vehicle, lock their butt up for one year. When I read about a person being arrested on their 23rd DWI I think all of our sate government officials should be fired immediately.
