Ya know.. I am all for 2nd Amendments rights like the next guy, but why exactly do you need to carry a gun on city property for anyway? Do they fear a rogue squirrel?..a stray cat? Justin Dillon and his croanies need to get some common sense and a clue that they are not helping the cause.

The State Uniform firearms act still forbids communities from regulating firearms carry...the law allows only the State Legislature to do so . I suspect this is not over until the State intervenes & amends the law or ultimately the Law is upheld & local ordinances ruled illegal.

I agree with State Street Observer - the issue here is whether or not the City of Erie exceeded its authority in regulating where firearms can be carried.

The 2nd issue is whether or not our (imho lazy and subservient to politicians) judges will rule on the matter, as a matter of law, before the 3rd or 4th appeal...

If a District Judge said the City Ordinance is not legal, I would expect that he or she would get a well financed - well connected opponent in the next election.

Mark my word, that's where this is going to end up.
If the State Supreme Court uphold this, it will be a sad day in Pa. It will mean that clear cut laws enacted by the legislature can be discarded by the courts. What's next?

1.Heller vs DC has no bearing on Pennsylvania law because Pennsylvania has already established universal & reasonable gun laws across the Commonwealth of PA.
2. In order to assure universal application the State enacted the Pennsylvania Universal Firearms Act which regulates everything to do with firearms in a universal manner across the entire Commonwealth.
3. In this specific issue the State Law forbids any township , municipality or county from enacting gun laws which are in violation of the Pennsylvania Uniform Fire Arms Act.This includes the right to carry.
4. By Pre-Emption only the State legislature is permitted to establish or modify laws pertaining to firearms & must be universally applied across the Commonwealth with one exception.
5. That exception is for First class cities in the Commonwealth who can require a license for open carry . This is codified in the Universal FireArms Act & allows Philadelphia the only first class city in Pennsylvania to require a permit for open carry.
6. In fact Philadelphia was found in violation of the Uniform Firearms Act b6y state courts in 2008 & had to rescind 5 different Gun Control measures they had illegally enacted.
7. As for what transpired here in Erie.....In reading The Universal Fire Arms Act, what the City did was a clear violation of State Law & will eventually be overturned.
8. A more reasonable approach would be to petition the State Legislature to review & modify the Universal Fire Arms Act.....IF IT MAKES SENSE TO DO SO!
9. If we had people on both sides of the right to bear arms issue willing to FOLLOW what the law allows private citizens to do, there would be no need for activists to hold rallies or engage in open carry activities on city streets or in city parks.
10.I do not think open carry is wrong but personally I think it is over the top in this case but certainly legal.

It's okay..it will go before a real judge on an appeal and the city ordinance will be deemed illegal, fines thrown out, ordinance tossed. Then all the anti-gun libtards will cry boo-hoo-hoo...
